Disclaimer for Selling Network Screener DVDs
Hello all--
This is my first post to this forum, I did an hour or so of searching the archives but do forgive me if the information I seek has been discussed.
My eBay account has been suspended for 12 months due to various "Copyright Violation - Unauthorized Item" removals-- 2 separate times in the past, 20 items removed at once yesterday. I've submitted my Reinstatement form, ID & utility bill.
The removed items were all network screener DVDs, which usually indicate that they cannot be resold. However I see that many other sellers of these items include this disclaimer:
"Attn VeRO Members: This is an authentic item, in the original studio packaging. It is not a copy and as such, is not in violation of any Copyright or Trademark laws. Sale of this item is SPECIFICALLY ALLOWED under the Copyright Laws of the United States [17 USC 109(a)] which states that "the owner of a particular copy or phonorecord lawfully made...is entitled, WITHOUT THE AUTHORITY OF THE COPYRIGHT OWNER, to sell or otherwise dispose of the possession of that copy or phonorecord." As this item was lawfully made and distributed by the studios involved, it may be disposed of accordingly, as per United States Copyright Law.""
I'm wondering if the above is true and more importantly if it actually works.
