While it is true that CD's were heavily counterfeited and the new releases still ARE heavily counterfeited, I don't think most of these are considered high risk anymore. I would avoid listing brand new new release CD's and also expensive box sets of CD's, but if you are listing single CD's that are a few years old for $2 or $3 (or whatever the market price is) you should be OK. I have listed used CD's on a new account before with no issues.
It is really the same thing with DVD's. If you are listing new releases, expensive box sets, fitness DVD's sold on infomercials, or classic Disney animated DVD's as brand new, then your account will eventually be questioned by eBay. But if you are listing you old copy of Hello Dolly, or Willy Wonka, then they will probably leave you alone.
