Default Ebay trademark violations cooling of period

Hi question to experienced Ebay users
I have been selling on ebay for long time , i have learned hard way i know my way around , there is something i have theory on and i think im right however wondering if anybody else experienced the same

After your item is removed unauthorized item , trademark violation etc , i have noticed that after 90 days since the incident account become fresh again, and previous vilations are forgotten , im basing my theory on the fact that once after serve incidents i have actually received private email from ebay representative (not automated template) to worn me if i have another one i will be out of business since then i have had 5 items removed all spread over long time period more then 90 days in between and it is still up , i remember there was thread about 90 days cooling of period on here but cant find it .
Basically can you keep your account safe when you run in to trouble , by stopping sales and let account rest for few months
Have anyone had similar experiences
Many Thanks Mike

I believe it's more a matter of how much money you've generated for Ebay between your trademark violations. If you went 90 days with no sales at all I don't think that would help, because your trademark violations would still be back-to-back if you were to get another one.

My theory has always been as long as your violations are separated by hundreds or thousands of successful sales, then you're good to go. I've had 8 or 9 violations on my busiest account.

I've seen Chinese sellers sell flat out phakes and not be bothered at all.....I monitor 3-6 of these guys and they have so many negatives, they could drown a HIPPO!

I have thought the same thing before OP, but it has not held up to be true 100% of the time. So it is a good theory, and I understand the basis, but, unfortunately, I have had it happen after a 90 clean slate of not selling.
