The TOS they offer still need to be legal and follow the laws of the land. It would be like me putting in a shop window "I do not serve black people" it is illegal. It is illegal for them to keep funds that do not belong to them over a certain period of time unless they can 100% prove fraud. In which case the funds should be given to the rightful owners, if there is no rightful owner it would go to the government not to them.
