ebay fined in France for allowing perfume to be sold

Saw this on Yahoo today...
Maybe this has something to do with ebay being so touchy about VERO items.
What I can't figure out is how can there be a law saying who can or can't sell something after they accquired it legally?

For instance if I have a Cartier watch and in this tough economy I want to sell it to raise some money why can't I?...just because Cartier wants to remain "exclusive"
