Default Buyer threatening me

hi can anyone help me please, i recently sold a quad bike on ebay. i originally wanted £1300 for it but it sold for £440 because i forgot to add a reserve price on the bid. Now buyer is threatening to take legal action against me if i don`t sell it to him. should i worry because my account is stealth. but i`m worried if he contacts the police as he said he would, would the police ask ebay for my ip or would they not bother to go that far. please any suggestions. thanks.

it depends what you have said so far regarding why you wont sell. You can send a cancellation notice, stating the item is damaged or no longer for sale or there was an error in the listing. Ebay gives you that right.

You are not obliged to sell if you change your mind, that is also part of the law.

Do not worry the police wont even look at it. nothing can happen to you, apart from a great big NEG of course!

That's right - you can cancel the transaction saying the item is significantly different than described, etc.

It's stealth so no details about you, not that it would matter.

You will prob get a negative feedback for sure so you have to trek on.

Live and Learn.

Technically though, in civil law, your auction ending is considered a sales contract which can be considered for court settling but whatever, I could go on...the end price is your acceptance of offer as per auction rules

Exactly, breach of contract is a civil matter, not a criminal one, so I don't see why the police would get involved. They would probably just tell the guy to file a civil lawsuit against you.

Yes - i always find it funny when people threaten with cops or get scared of cops....it's sad in a way but I digress.

Nobody can force a seller to sell..
However, buyer can file the Non-Performing Seller complaint and the seller will receive a violation (equivalent to a strike given a buyer).
Too many violations will result in sanctions against the seller..

Do not tell the buyer you want more money" and you forgot to use the reserve feature for the listing.

Tell the buyer that something happen to the item, like breakage after it was won but before it has been shipped, then you should refund the buyer explain the issue and cancel the transaction. That would be within policy.

Since he is threatening you that would mean you have already told him you don't want to sell it at the low price I assume...

So damaged or stolen or whatever excuses wont fly now.

There is no legal issue here at all. You will get a negative and complaints to ebay for sure. But for 900, whatever. If account can handle a neg, fine. if it kills account so be it.

I've won auctions for way too small and sellers have backed out. Its annoying for sure. But I'm talking about an item worth $70 for $10 or something. Not $900 less...

I would just say you wont sell and take whatever lumps you get with ebay. Anything else he claims he will do legally is just wind.

I see you said accounts plural - So just leave it be for awhile and see if it survives the storm. If it does cool, if not, whatever

Now we are not talking about a $50 camera or something here so I really want to give you a hard time on not putting a reserve on a $2000 item [USD] but I wont...
