Default Item Not As Described Dispute Closed, Refund WITHOUT buyer having to return ite

I just had an item not as described dispute closed and refund was given to the buyer without him even having to return in the item. WTF?!?!

Did the buyer escalate it to claim coz If you give refund for dispute the buyer can keep the item and nobody can force him to return the item back

Same happened to me few months back, twice actually, I fought back and then PayPal had the nerve to say we have resolved the case in your favor and granted a refund for the buyer, lost 200$ CRAZY!
Where is seller protection?

Seller/Buyer protection are all lies. No buyer or seller is really protected. Being protected is only a 50/50 chance. That's why I never buy or sell expensive items on Egay anymore. I got burned too many times especially with defective electronic goods from China.

I was wondering the same. Whenever this happens, I request the item to be returned ASAP.

Yes this sucks big time and really pisses me off that scam bidders get away with this kind of stuff. I had this happen to me a month ago and the seller got to keep my product. This is for Octopuspaul...even if it was a replica the buyer has no right to keep your product and get their money back because rather it was replica or the real thing we the seller have to pay for both items

eB ay can pull this crap any time they want. Just consider yourself lucky if they don't. I used to sell a particular product that was a bit pricey and had this done to me 3 times from scammers. eB ay questioned nothing towards the buyer, they simply said that nothing can be proved so we gave your customer all of their money back, let them keep the item, and screw you with false negative feedback. I tried to fight all 3 disputes and all I ever received was auto-responses.

yep i also had this done to me on a 400 euro jacket!!! he never returned it and they still refunded the guy WTF....

This has never happened with me, the buyer has always had to send the item back?

Do you know what kind of argument your buyer presented to paypal/ebay?
Did he say it was a replica?

Buyers are not required to return items that the buyer does not believe is authentic--per ebay's help page.

Was this a VER O item and the buyer just decided to falsely say it was a replica? So does that mean all a scammer has to do is claim replica and bingo he doesn't need to return it? That is f*cked up.

I have had this happen before, however ebay/PP didn't take the money from me. They let me keep my payment and let the buyer keep the item but they refunded them. The email stated so also, that they chose to issue a refund immediately. I thought it was weird but I didn't care since they didn't take the money from me!

I believe that what che2009 said is truly the case, and even then sometimes it just simply doesn't matter. My items were not Ve RO, eB ay has all of my invoices from distributors on file, and all of my distributors are legit USA based companies. I lost all 3 cases and didn't stand a chance. Customers just opened disputes and said the items were damaged or not as described. eB ay says that nothing can be proved otherwise so you lose.

Opened disputes go against my DSR which can eventually suspend my account, customer gets free products and screws me with false negative feedback.

Of course I block the customer forever, but the deed had already been done to screw me over.

The item was not a replica, it was for an item not as described dispute. The buyer said "I have mailed the package back you should have it shortly and updated the dispute to a claim". Boom, about a week later the closed it in his favor. What a crock of ****ing ****!!!

Well i had one dispute few days ago and ebay told buyer to return item to get refund and i was told to issue refund only after getting item in hand.I guess you are doing something wrong.

yep said it was ⊗⊗⊗⊗ so they advised him to destroy the item and p a ypal refunded him!!!

It wouldnt matter what u sold phake or real its all up the the buyer if he wants to ship the item back or not cause paypal refunds him reguardless.

well in my case I was not selling a VERO item but what happened was PayPal tookt he funds out to "hold" it until this case resolves itself, then i was in communication with the buyer for a few and finally after this was finished they ended it with the result in " my favor" and refunded the buyer the full amount. I had to mark a filed saying I will accept a return if the buyer ships the item, so I guess they count the buyer would do that and hwo would pp know they shipped it if there isnt a field to mark that I received the item back?

I swear a shady person can decorate their whole wardrobe, electronic collection, and house decoration and goods on Ebay for FREE with 10 ebay and 10 paypal accounts.. Crazy stuff
