Default i need advice as im getting scammed with a scammer

hi
please help so i know what to do.
here is my story so you know whats happened
so then i got a buyer send me a message saying he was after 1 of my items.

i posted it to him and 3 days later i got a message back saying it was the wrong model and could he return it.
it wasnt the wrong model as i double checked and it was the only model he specifically asked for that i sent him

he posted back the item but it wasnt what i originally sold him or it had been damaged in the post.
hard to tell as it was sent in a plastic bag and the bag wasnt torn etc.
anyway i told him that id recieved it and that it had been damaged and that since he arranged the return courier he would need to put a claim in for damages.
i took some photos for him off the damages so it would help him with his claim quicker whilst he was waiting for the item to get back too him.

i sent it back with tracking numbers and told him the numbers and now its still shown as undelivered ie its lost in the post.

he had opened a case up with ebay and now hes been refunded and ive posted his damaged parcel back.

so ive lost the money and the parcel.
i had originally phoned ebay up and i was told to return it and thy said that they would refund the buyer and i could appeal it,but how can i appeal it if its been lost in the post.
who makes the claim now.

when you sent it back, did you purchase insurance? If not, I would say you're out on this one.

no i never as it was already damaged
i also forgot to mention that on my paypal account i was overdrawn because paypal had put a hold on the funds.
ebay resolution are saying they have refunded the buyer and paypal have now released the funds.

so now my accounts back in credit again at 0.

do i now owe ebay or have ebay refunded him because of the couriers damages and none of us have won.

if i look on the closed case it does say.
i dont need to do anything case closed
but
there is also a link saying pay now.

to be honest, I'm having a hard time understanding...
How is he a scammer, if he did nothing wrong?

here you write

which one is it, did he send you something else or was it simply damaged?

then i read

" anyway i told him that id recieved it and that it had been damaged "

so I'm assuming it was just damaged..

He returned the item, however unfortunately it was damaged during transit, and he never received the "Damaged" item back so of course he opened a case.

as we all know, unless you are the buyer, ebay/paypal side with the buyers 99/100 of the time.

So then in the case he opened, what did he state. He returned item and never received the refund?

I would honestly consider it a loss. No insurance on the item, so you unfortunately cant make a claim. Hopefully It wasn't a huge loss, we learn from every mistake, every loss. if something doesn't sound right, cover yourself.

hi
he originally said he wanted a psp 3003 so i sent him a psp 3003.

then he sent a message to me saying hed recieved it and id sent him a psp 3000 and he wanted a psp 3003 so could he send it back to me for a replacement.

then the same day he said he posted it back that is when he opened the item not as desribed case saying that it was a 3000 he had recieved and that he was posting it back to me for a refund not a replacement.

when it turned up it was a 3003 which is what he wanted but it was damaged.
so i dont know if he had posted me his broken psp back and kept the one i posted to him originally or it was damaged in the post.

i couldnt tell as it was damaged and there was no distinctive markings on it.

either way it was damaged so i told him that id recieved it damaged and i would need to post it back too him.

id phoned ebay up and they said post it back and appeal the decision when he wins and he will win coz he posted it back to me but i can appeal it on the grounds it was returned in damaged condition or missing parts etc or it was not what had been originally posted to him.


so from day he decided to return it case was open
and now its closed in his favour .

so now i have to appeal it but he hasnt recieved it back as its lost in the post.

so i think ive been scammed and also lost the psp and now the money.

@OP, sad to say but sounds like a mess. You are posting late and asking for advice. When you are not sure about how a sale is going, post EARLY to ask for help on steps to follow.

You can keep fighting with pp and trying since you know your product best and have tracking for the replacement. If you cant, let it go and take it as one to learn by.

You cant have everything solved so easily :(

What did you have to do to get that sorted?

becuase as i understand it...on a return the item has to be delivered not Sent.

i phoned ebay up and told them that it had been returned as broken by the buyers courier and that i had returned it to the customer so they could make a claim.
once i provided tracking numbers to ebay resolution team and i phoned them to ask how do i email the photos of the damage to them,they told me that nobody would try and email them photos or return it if the product wasnt damaged so they found in my favour and refunded the full amount back to me.

buyer has been in touch since and actually told me that hed knowingly returned me his already broken psp back and that he was trying to do a swap since mine was in better condition.
ive told ebay afterwards and they said that theyl keep an eye on his account.
since then i think hes now been kicked off.
change of subject but does anybody know that since my account is new to ebay again i can only list 3 items a month in the psp category.
some twats bought 1 and has now been made a unregistered user.
another twat tried to get me to post 1 to nigeria and the 3rd was sold and recieved and left good feedback,but because of the two twats i cannot list in the same category for another 30 days.
is there anyway around this.

Hi,

I was just reading this thread and had a feeling he was a scammer, as soon as he told you it was the wrong model that you sent. Scammer looking to swap old for better one. That is why I stay away from high end goods, the amount of **** I had to take at the start just to keep my account in good standing. Good luck in you future selling mate.

Isn't there serial numbers on these items? Should be very easy to check if the right one was returned. That goes for most items like this
