Default PayPay took me up for 6000$

Hi anyone, maybe its too late for asking advice, but ill share, my experience

Have an old established account 8 year old
maybe 1000000$ turnaround

4 months ago had a deal with old costumer.
Sold him stuff for 6000$ value, sent to Saudi Arabia over Fedex tracked service, 20kg
Customs stopped this package and asked him to clear import

buyer havent done so and opened a dispute with me instead since 4 months of dispatch

Paypal requested all the paper, these have been provided, several call were given to paypal and case was closed in BUYER favour, as item is not delivered.

i still have 10 days to appeal, but is there any chance to do that successfully?

why there no seller protection? local fedex rules says to destroy the package at the end of all

I dont understand.

But as far as item not received, well, the buyer did not receive. They get a refund.

It is now up to you and fedex to get your items back.

Not going to win this one I am afraid

Buyer did not get the item so they will win the case

Best thing you can do is talk to FedEx to try to see if you can get your items back!

The package wasn't delivered.

Seller protection only applies if the package gets delivered.

Thee is no point appealing the decision if nothing has changed.

You need to contact FedEx and try and get the parcel back.

try and tell paypal you agreed by email that buyer was responsible for all import duties etc.

you still might not win though...

You did not deliver.

How can you win a item not received case when the items were not received?

i am not responsible for customs clearance process, item is in buyer country, all he need to do, is to go and claim for the package after import fees are paid, as easy as that.
he just need to pick it up

Only when the buyer signs for the fedex parcel. Then it is considered delivered.

No signature = not delivered.

Did you have a return address on the parcel?

You can phone fedex and PAY to change the delivery address on the parcel.

You are the sender. You are allowed to change the address.

Just for your future records: YOU as the seller are responsible for all parcels until they reach their intended customer.

Paypal/ebay consider the carriers your business partner and hold you liable.

you are paypals hands....paypal might tell you to swivel and tht you need to take buyer to court, yeh good luck in uae...

In USA paypal, it is clear buyer is responsible for duty/vat etc...BUT you are still responsible to deliver. If buy does not pay fees, it is between you and the carrier. This is paypal's policy.

It is any credit card processor, not really paypals fault.

It is you BUYERS fault.

Sorry, that is a big loss to take and it sucks.

Better contact FedEx as soon as possible and try to get your goods back or youll lose both money and the item.
Forget about the payment and invest your time where you at least have a chance.

You're in a bad spot. There's no point in arguing about terminology. Since you're familiar with bank transfers, why didn't you have your buyer do that? Or any other payment where chargeback's aren't possible?

All you can do is try to get your parcel back. There is no way you could appeal. If I were you I'd travel to where ever I sent the parcel trying to get it back. $6k is a lot of dough to give up without a fight.
