Only, if there is money in his account for them to deduct. If there are no funds in his account, paypal will tell you to suck a lemon.

Even if I stated that I'm paying for a 'Service' I'll still win?

Maybe: if there is no money in the sellers' account, then no.

NO, I have had a disputeI did not reply to that was a 'service', but since they cannot verify anything you would be lucky to get the money back.

The seller does not have to reply to a dispute in some cases, 1 of those is where a buyer is not liable, ie a service, not trackable item or item did not match description, but was delivered.

I've received this auto mail

Your dispute for the payment you sent to Ankit xxxxxxxx will automatically
close on May 17, 2009.

We will assume that the dispute is resolved and will automatically close it
unless you log in to the Resolution Center and escalate it to a PayPal
claim before May 17, 2009.

So do i have to escalate to win? Or I'll still win like that?

Yes, you have to escalate it to a claim before the date listed or nothing will happen. The way it is right now, is trying to get you and the seller to come up with solution before paypal reviews it.

I've already posted something (hence the dispute few days ago), so if I don't escalate what would happen?

Absolutely nothing will happen if you don't escalate it.

nothing will happen until you escalate it. at the escalation point, then the claim actually takes place. i usually let the buyer initiate the claim and I don't reply if I feel it is bogus claim. I won't reply until the buyer escalates the claim. Until then I hope that the matter just get dropped because they forgot to escalate.

Come to think of it..I hope this claim of yours isn't out against me??!!! LOL

Escalate it if you want PayPal support to decide who wins.. depending on what the seller provides as evidence, you win or lose. If the seller doesn't reply, you'll most likely win.
