Default Copyright infringement

Ok, I got one copyright infringement for a charm I had no idea was copyrighted. (I bought it from an Etsy supply shop in the UK).

One year later, I just got another copyright infringement for a different charm again that I bought in a bead supply shop in the UK. I don't at all agree it is a copy of someones work and I'm not taking it further, but nevertheless it's still a strike on my account.

So what now? One more and I'm gone?! Or is it three strikes and on the 4th you're gone. How can anyone rely on this as an income with the threat of another strike. It would just take one bogus one even, which is what the last one was. It's a really horrible thought.

Does anyone really know how many strikes for copyright infringement and your shop is shut? Do you get a final message from Etsy saying you have one last chance? Please could anyone shed some light as this is my only income for now.

Usually with an account of about 1 year of age it's 4 strikes and on the 5th strike you're gone. They'll send you a final warning b4 your last strike.

Legally speaking they should boot you at the third strike, but if it’s an older account you can take a few more sometimes.

If you bought the charms, reach other to whoever is sending in the strikes and explain the situation. You’d be surprised how reasonable some people can be.

So you bought them and tried to resell them as used?

Or did you buy a knock off?

I feel that if you are just trying to get rid of a second hand item, it shouldn't be an issue. It's yours to do what you want with your personal belonging.

Yeah, this would likely presents a pattern of large scale infringement.

Nobody's going to get dinged for just one sold 1 time.

The OP almost certainly has a LOT of these listed and has been selling many more than just 'a charm'.

Erm, I don't see this as large scale infringement, this is what worries and concerns me!

These were both charms bought in the UK from a very reputable supply shop on Etsy. I then made some necklaces and bracelets using these animal charms. They were certainly not anything that was clear I was breaking a copyright such as a disney or hello kitty design or something like that, I wouldn't be so daft.

The second charm in question was a different design (it was an eagle design but the top of both charms were quite different) to the one listed as the infringement, however I have been advised legally not to counter file a DMCA as I'm in the UK.
