Default Can you sell uggies on Ebay AU and be fine?

Hello Good people of the forum,

Hope all of you had a great New Years and let's hope for better sales in 2011!

I am in a bit of a dilema because I have been planning on buying bulk quantities of Ugg boots, not ⊗⊗⊗⊗ Decker's Ugg Australia, just normal uggies that dont infringe Decker's trademark. You see, here in Australia Ugg IS still a generic term and used to describe a 'style' of boots. We've had uggies before deckers trademarked it.

I have done a bit of research and know that UGG is considered a trademark infringement the world over. I am seriosly considering investing in about 500 pairs of uggies and until yesterday thought I'd be safe as long as I only sell in ebay AU since in AU selling ugg boots is not infringement.

And then I find out a bunch of threads on the forum about people who got kicked in the shin for selling as little as ONE pair of uggies! And even AU sellers who got the boot.

Can anyone please advise me, or just give me their opinion on this matter before I waste my dollars on something that could potentially ruin me? How can selling normal uggies be totally legal in a country, yet have different rules for selling the same on ebay? I always see different australian companies selling ugg boots everywhere in the mall here. I am just a bit confused. Any input is greatly appreciated. Thanks so much

Coptright\Trademark Infringement is a Tricky and Complicated issue,,it Depends on A Lot of different Variables around the World,,,

To Me your Situation is a Good one,,,You Have not spent 1 Cent yet,,,

My Advice to you is Simple,,,,Since there is this "Cloud" That hangs over your Intended Product that has the Potential to cause you considerable grief,,,,AVOID It,,,Walk Away,,,

Seek your entertainment Elsewhere,,,in other words find something else to sell and let those already trapped in that web sort out there own Problems,,

Agreed - Not worth sitting on 500 boots you will have a hard time unloading even if it is technically legal where you are.

This is EBAY - They make the law even if it doesnt make sense

if you have done your research and examined other listings, and the items do not infringe trademarks, then go ahead, but because ugg is a hot vero and yours may get caught in the crossfire, I think you should not buy in bulk until you have tested the water with 5-10.

While sides of the coin offer good advice, I myself prefer a trial run/taste test when I sell stuff/ Like oompa has denoted, get a few pairs and see it goes - spread out.

Thanks everyone for their contribution. After much thought, I have decided to go with what you guys are saying. I will only get a few pairs and test it out. If I decide it is worth the trouble, then I can always order more.

BTW, Iam going to Guangzhau China, the lair itself in feb. It happened to be a stop over transit for my overseas holiday, and I thought, why the heck not stay there for a few days, scoop out the vibe and maybe help my ebay business. Will report back on how the trip went. Really want to find out if it's worth going to the country itself to source out supplies when you can do something similar online. Anyway, thanks for all your help, and have great sales
