We sellers are "agreeing" to not participate in a class action lawsuit against eBay and any legal claims (They say) must be presented in a Utah court. This cannot be legal! To continue to use eBay we have to agree to this?!

When you look at the contracts, TOS's, User agreements, and etc, you see a lot of clauses that are almost never upheld when challenged in court like waiving your right to sue or mandatory arbitration clauses. This is one of those kind of clauses. They put it in user agreement because they have nothing to lose and it will deter the legally uniformed.

I guess they can put anything they want in there, but if it's upheld by the law is another thing..
