Hey,
Hopefully my question will not appear to be too naive - and it's a pretty simple one. Today, I was served with an MC019 notice. It's a trademark infringement notice they got me on and I know there is no way to fight it. I was wondering if they could find out my personal info from eBay when serving this type of notice. I googled the company to find that they are, indeed, suing people for committing trademark infringement.

Did you use real information or stealth? Selling VERO? Did you just use other pictures?

I had used my real personal information, yes :(. I'm totally new to this site and had not realized that I should have taken these precautions. The product is a fitness tool so I do not know if it's considered to be a VERO product. The pictures were my own. I had two listings up that were 1 day listings but were killed within hours. |

p90x? If you're not doing anything illegal, I wouldn't worry about it.

dont worry about it, the owner can get your details but is unlikely to put in effort over this infringement, if you stop selling it on this account...

actually, people who sell this product on eBay who are not authorized to do so have been taken to court. Most of the time I would say don't worry about it. The reason I asked about said product specifically is because they're known to higher attorneys and prosecute. Be careful.

If it comes down to it, stash your inventory and just say you copied pic's off the internet(of items you thought were legit) and that yours were real items that you bought off craigslist from a guy who's company went out of business, make an invoice and I'd say you covered your as.

There's probably a thousand free invoices if you do a search. I use google docs, whichever format you prefer. It's impossible for them to say it's ⊗⊗⊗⊗ because how would they even prove it? Especially in a court of law. |
