Brand Registry rights revoked
 

Hi All, so my selling account on AMZ was suspended for over a year for IP violation. In the meantime, my brand registry has been revoked. I've managed to reinstate my selling account but I'm having difficulties with the brand registry. I have a USPTO registered trademark. I cannot submit a new application because it says this TM is already registered and the support team is no help at all.. its like getting random answers no matter what you write to them.

Did anyone have a similar issue before?

If you were accused of applying your Brand Registry to a copyrighted or patented item then you can kinda see their problem with you. Is this the case?

It's a common issue for white label sellers thinking they can simply apply their trademark to generic wares purchased from China - then someone jumps out and claims they own the rights to the generic wares. If their paperwork is dated before yours then Amazon will side with them, rightly or wrongly.

No, that's not the case. The item we were selling at that time was just a test product which we did not pay too much attention to and it led us to that violation, but it wasn't branded with the brand in question.

The brand we have registered is only selling products which we manufacture at our own production site and the everything is carefully examined before the product is released. All the designs are made by us so we are sure we're good on that part.

It was just a silly mistake we did when we wanted to test the whole process of selling on the US market with a random product, but this has nothing to do with our brand.
