Use your IPR VERO intellectual rights if banned?

I own intellectual property rights (IPR , Vero) on several remanufactured items.
If I upload these to the Amazon catalogue, then get banned (for too many negs for late delivery for example), I think I'm right in assuming that the items remain on the Amazon system.
Then I could go stealth and continue selling, but if a competitor decided to list against my original items also, am I still able to get Amazon to stop him?
