Default Contractual Agreement question

manufacturer is asking me to sign agreement to not resell online. There are tons of sellers selling this stuff on Amazon. agreement states penalty will be $100 per item if contract is broke.

I dont want to get sued over this??? If they void the contract so what???

I was even thinking of using a sealth for this. That is a whole new ball game for me though because I only run my legit account.

It could be a product like Moroccan oil. Which is serial numbered per bottle, and they can see which reseller bought them. So they do test buys on amazon and sites. Once they catch you, the will close your account.

I personally wouldn't risk it.
I have gone after people online myself for breaking an agreement like this.

And I was relentless.

YOu can think about using an Amazon Ghost account, but still, you need to decide if it's worth the headache for you or not.

It's not about whether you have the money or not, it's about getting you off from selling items that you don't have permission on.

And with a ruined credit, life can be very tough when you need to buy a house, get loans etc.

Btw, there was a thread I just read where someone accidentally signed for a letter when he received it and it was from JnP. Reading that thread is a headache.

So don't sign anything if you don't know where it's from =)

What will happen? Hard to say. Why risk your whole life to sell this stuff? Find something else.

And saying "I'll never go to that state" is meaningless. They'll sue you in the state specified in the contract, when you don't respond they'll win, and they can transfer a judgment anywhere and ruin your credit and maybe your life.

I've called the police, and when the cop arrives showed them the judgment and had them enforce it directly on the creditor.

Most places you can actually take a judgment to the creditor's bank, and seize any funds they have in any account of theirs directly from the bank.

If they have a place of business you can actually show up at day's end and clear out their till.

There are other remedies as well, and trust me, I've done them all. Don't be an idiot. Follow the rules or move on.
