Going to arbitration with Amazon
 
Wondering if this is something you can do yourself.

I have spoken to a number of lawyers who ask for upwards of $8k to begin a case. Which is nuts, if you asked me.

But can you engage Amazon by yourself?

Too...what if the account in question that they are holding the monies is not in your own name. Is this a problem?

wondering if anyone has insight into this.

Have one account where Amazon is holding funds.

Any help would be appreciated.

For full legal action, it could be a problem.

I was looking into arbitration, and it's quite possible to do it yourself. It appears Amazon is holding funds more and more often. If the amount is under $10k Amazon can be forced to pay the entire arbitration fee.

Not sure that matters, the more I think about it.

I signed up to the account as an LLC...even filed documents saying that I was a business...and had an EIN instead of a SSN because I was a business. As with all of my accounts.

So, I can simply claim the arbitration in my name, on behalf of my business, which has a documented EIN, and is registered with the IRS.

If the money was under a ghost name, open a DBA or LLC under that name.

Get a lawyer to initiate arbitration.

8K is in the low end, some firms charge 25K to take the case.

Most likely you will win because there is no law to back up holding your monies indefinitely on suspicious facts or under the premise "we believe you may have sold fofo items".

Evidence if any is gone.

There is absolutely no reason to pay a lawyer any money.

On Amazon's site they outline the dispute process. You send your case to them first, mostly likely because if you have any case, they will settle.

If they don't, then you send it to the federal arbitration office, also noted on Amazon's site, and you make your case.

If you pay a lawyer, you obviously can't write. Because all a lawyer does is listen to you, and basically format what you say...and then take your check.

Nine times out of ten, lawyers are absolutely unnecessary.
