Trademark & Suspended Account

We have a Trademark under the company's name but got suspended when trying to open the account.
We found a seller who will sell our product exclusivity. My question - can he use the trademark for EBC or since the company is suspended, no one can use the trademark, not even other sellers?

And if that's the case, should I transfer the trademark under a different name?

If you can easily change the information, that is the lower risk option

But it sounds like it wouldn't be a problem for the other seller to sell the products if you never got the chance to sell them (suspended before selling any)
