Taking Amazon to arbitration
 
Have formally begun the process of taking Amazon to arbitration. Am based in the US, and they held back a considerable amount of money, and have pretty much stopped discussing it.

I sent a letter to their agent of record. I received an email from their lawyer about the case three months ago. I have emailed and phoned said lawyer representing them, but have heard nothing back in months.

So I decided to move forward.

I have some questions for anyone who has been through this before.

The big question is, say you are awarded the money. What power does the arbitration group have over Amazon? I mean, couldn't Amazon agree to the arbitration, then say, tough, come and get it...and good luck in trying?

My other question is, can you attach any damages to these arbitration hearings and be awarded them? I mean, it would not take much to prove that Amazon has acted in bad faith. I don't care what their rules are. You can't simply make stuff up, then act like judge, jury and executioner as hey are doing?

Anyone asked for or been awarded damages?


Finally, how long does arbitration take? I was told by the AAA that I would hear back in two to three weeks. Which would be great.

Anyone actually go through with this process? Would love to hear your experience.

They shut me down for too many cancelled orders and then said i did fraud or something and refuse to send my funds or reply to me. i chose not to do anything... i have a friend who also took them to court and went to Seattle and lost... they have about 5k of my money and over 30k of my friends and it was my personal account not a stealth/ghost. i am confident that maybe 20% of their worth is from people like us who get robbed by them. goodluck

yeah my lawyer who has dealt with amazon quite a bit said if you take them to arbitration is 99% chance you win, amazon cannot really fight it, the reason is most sellers are afraid to go after amazon he said, so how did your friend lose?

Here is what I've heard from someone who knows this Arbitration process well :

First, you must have used your real information.

Second, if you committed fraud then you probably won't win.

Third, Amazon HATES it when people take them to arbitration because it costs them about $10,000 each time in internal legal fees and arbitration costs. So if you are trying to recover less than $10,000 they will often try to resolve it before it goes to Arbitration, so that could bring a quick resolution.

If you are truly in the right and properly present your evidence, then you will win.

If you win and prove how much they owe you then Amazon will pay you. I assume it is binding Arbitration, which means just like if you won a judgment in court that Amazon will have to pay. They can't 'hide'.

I don't think you can win pain and suffering type damages through Arbitration, but I'm not 100%.

There is also new US legislation being passed that is going to force Amazon to give people a specific example of why their account was closed along with other remedies. So when this passes, it will be helpful.

*Separately, for others : if Amazon has stopped responding to your requests and you used your real information on an account - then file a complaint with the BBB and they will reach out to you.

They hate when people leave BBB complaints or file for Arbitration. Both are very effective at getting Amazon's attention.

No, not for violation of conduct code. They alleged that I had another account. I most certainly did not.

They have gone ape**** crazy.

Used to enjoy the days when you could leave them hanging...oh well.
