What are my chances of passing this?
 

If I change my seller accounts:

A) Legal entity from a Canadian Sole prop to a US S-Corp
B) Business address from a Canadian address to a US address
C) Canadian Business Number (sales tax number)
D) Bank details

What is the pass rate if I do this? Accounts older then a year. Good standing. Lots of sales, good feedback.

Im guessing they will suspend and request:


--Utility bill
--Business License (If applicable)

Hopefully this will be the last of it and the business license says "If applicable" (I dont have one). The address is a mailbox rental as well.

The second challenge would be if the EIN I enter on the legal entity for my SM-LLC S-Corp is accepted by the IRS database. My LLC is currently registered and I made an S-Election not too long ago.

Don't think Ive ever heard of anyone trying something like that.
Whats the point? why not keep it on the original details?

I am now a US S-Corp. I will have to change it as I am now operating under a completely different entity with different tax information. The Amazon account must match this.

This isnt some small ball mom'n'pop sole-prop setup with the name of a relative or something.

If you're pushing any serious numbers while operating its seller account under a different tax and legal entity your asking for trouble IMO. Especially if you are operating in a capacity outside of a sole prop (LLC / S-Corp).

Theres so many different areas that can go wrong here. What if Amazon.ca starts reporting to the CRA? They'll think I live there and will try to tax my income. What if the IRS audit me? Will they be okay with my seller account being under a foreign entity or would this piece the corporate veil? (It will). this could be ground for the IRS to deam you operating as a sole-prop the entire time and subject you fees, penalties and back taxes and remove your LLC protection.
