Services to help with hijavkers
 

A hijacker is taking all my private label brand listings and changing info and selling on them.

Is there any service out there that will test purchase and report the intellectual property violations?????


My trademark is pending for 5 months still and amazon keeps denying copyright infringement requests

You would have to do the same on your end, I doubt there's a company that provides that kind of service

If you don't have a trademark to enforce then these not much point trying to employ a firm to manage it for you.

You'll just have to sit it out until you do, even then don't assume Amazon will recognise it or enforce it. Best look at Brand Registry.

went through the same thing. cant do anything without owning the mark. EB and AMZ said the same thing. it's brutal

Legally I own the copyright material. Regardless if the trademark is active, still no one can help?

If you think the advice here is wrong and you have a case then speak to a lawyer, but as you've said you're operating nothing more than a private label operation then I can't see you having any success.

What 'copyright material' do you to have that is legally protected?

A private label company will own copyright 9/10 times. My Copyright material is my branded packaging

I have a lawyer they are having there notices rejected by amazon to. I’m not going to follow up with a lawsuit..

yes, copyr.ight meant nothing in my experiences. AMZ and EB said show the proof you own the mark or we can't help you. had people copying everyting from me including descriptions and all pictures.

If you don't own your brand , there's nothing you can do.
And as a small brand owner it's not the easiest thing to do on its own too.

Did you hijack an asin or made your own?

In USA Copyright is valid without copyright registration. If you start a copyright design/brand you own the intellectual property rights WITHOUT trademark registration or registering the copyright


Just to be clear You own your copyright the SECOND You created the design/brand

Take it up with your attorney, Amazon have their policies and there's nothing anyone here can do to change that.

not even sure what u mean with that last comment. are they removing the hijacked listings now?

and the issue is not whether you own any cop.y.right, it's whether or not AMZ/EB care. When I was attacked, both EB and AMZ refused to do anything without proof of mark ownership. cop.yright meant nothing to them. they said i had to get the mark, then register with "brand registry" and "ve.ro" in order to be protected. there were no other options. EB trust/safety team even went out of their way to show me the section explaining this in their TOS
