Amazon Business Solutions Agreement Allowing Confiscation of Seller Funds Held Unenforceable

Washington Arbitrator rules section 2 of Amazon’s Business Solutions Agreement, allowing Amazon to indefinitely withhold funds in its discretion in cases of alleged product inauthenticity is an adhesion contract and not enforceable.

Amazon Sellers Attorney, a lawyer-supervised suspension appeal service, announced today that a Washington arbitrator has held section 2 of Amazon’s Business Solutions Agreement, which allows Amazon (AMZN) to hold funds indefinitely if they suspect the third-party seller sold inauthentic products, is not enforceable and ordered Amazon to release the third-party seller’s funds.

But does this mean amazon can't really hold funds indefinitely anymore or is that just a 1 time thing for that specific seller?

It means that if you have a sizable amount seized by Amazon and you go into arbitration you have a good chance of getting all your money back citing the principles of this case. If everyone did this Amazon will release funds before arbitration as they will not want cases using the adhesion contract to win and build up against them.

Adhesion contracts are very common, such as mortgage contracts, vehicle financing and cell phone contracts use this. One that you can not negotiate, to make it legal it needs to adhere to state laws in all 50 states.

Amazon seizes goods and funds if they suspend your account and claim that your selling inauthentic product has harmed their company. Where they fall down when challenged is that they have to prove monetary losses because a seller sold claimed inauthentic product and they can not and that makes that part of the adhesion contract null and void if they use it against you.
