In any event, Amazon are very inconsistent on this. They will either take the other seller offer down, albeit that you might have to badger them a bit or they will play the old 'We respects a manufacturer’s right to enter into exclusive distribution agreements for its products. However, violations of such agreements do not constitute intellectual property rights infringement. As the enforcement of these agreements is a matter between the manufacturer and the retailers, it would not be appropriate for Amazon to assist in enforcement activities' line.
The latter seems to go against their Brand Registry message but when you get a clueless asia-bot it's the easiest way out for them.
The other option is to threaten the other seller with test purchases and if they persist then follow through and report them as counterfeit. That said I've see ASIN's closed down for this because the assume all offerings are f@ke. I'd completely exhaust the legitimate Brand Registry route first though.
