It'll be under his/her name and you have to file it.

So give the 1099k to him and add whatever $ tax he owes

What if I create an LLC and upgrade to a Pro Account? Is the 1099 issued in the name of the LLC?

If it's a business account then it'll be under the business name.

But do remember that the pressure if even higher because you have to make sure you do pay their taxes...
