a-z claim wtf!!??

i sold an item to this idiot and before he even received it, and after i sent it he put in a claim to cancel the order. so i said to return it. well, he puts in this a-z claim and i tell amazon the same thing. i will refund it after i receive the product back. the guy claimed item was "significantly different than described." it wasnt, and how would he know if it was if he hadnt received it yet!

anyway i stated my case and waited to hear the results. well i never heard anything one way or another, so i figured maybe he just dropped it. well i found out today when i tried to withdraw money from another item that they were holding that money from me. so they awarded in his favor. so thats how it is? he just gets his money back and doesnt have to send back the product or anything? this smells of a straight up scam to me. anything i can do? appeal, etc?

Gamefreak 12-02-2011 02:36 PM

Whenever a buyer files a claim amazon holds the money in reserve for 30 days. That doesnt mean you lost the case but I urge you to contact amazon. Post messages from the buyer and show that the buyer is trying to scam you.
After amazon concludes the case you should receive an email from then that you won and lost the case.

rsot 12-02-2011 02:46 PM

90%+ time, a buyer will auto-win an A-Z claim - Am az on will SCREW over sellers like that...it's a well-known rule - sucks but yeah, you/me/others have lost both product and money to this fugged up rule proof or no proof.

dakota5369 12-02-2011 02:53 PM

thanks for the response, but it says the claim was granted. seller funded. the last notice i received about anything was i needed to supply a return address to the buyer, which i did.

hell, i dont know. if it says claim granted, why is it still in the under review section? i already appealed it.

rsot 12-02-2011 03:19 PM

It prob just has not updated yet - claim granted means you lose =( sorry but its the truth

thanks. that really sucks though. do they not even look at the history? the guy said himself in the claim he tried to cancel before i sent it but it was too late. then he negs me and says the item was not as described. if any person looked where he said he tried to cancel before it was sent, how could they turn around and tell him to just go ahead and keep the item PLUS get the money back? amazing

Gamefreak 12-02-2011 04:00 PM

thats the cost of doing business own amazon sometimes...

rsot 12-02-2011 04:02 PM

If he has not closed the claim by himself, then it is a fail - you can hope that he is honest and will mail back - toss him a message via Am az on and hope.

yea, well i doubt that will happen since not only did he not send it back, but he negged me for no reason on top of it. maybe he was a competitor

Artann 12-02-2011 06:19 PM

^^ I think u r on to something here with a competitor ... it's not enough that amazon hurts us up to make things even worse we do it to each other... this is the Great American way =}

durdajan 12-02-2011 06:23 PM

this is just because the utility a random seller can bring to amaizon is less than the utility a random buyer can bring to amaizon, that's why))

dakota5369 12-02-2011 06:48 PM

i did email him and ask for it back. this is what he sent

Well its a 60 day program and im not quite done with it yet. I would have gladly returned it a while ago if you would have been cooperative and just approved the return and if you weren't such a dick. Is the return address the Las Vegas address on the envelope?

so he is admitting he is using it and isnt done with it!!! can i send this to amazon and win now that he is admitting he is screwing me??!! wow, if this guy can just admit he is using the product AFTER he got his money back and wont send it back until he is done, i am gonna go apre****. no way can amazon allow that.

yea, this is my legit account too. i know making a scene about it will probably cause me to lose my account, but this pisses me off so bad i dont think i care. my sister is an attorney and i wonder if i get her to make some kind of letter to amazon will help. i heard they back down if/when legal action is threatened.

its pretty cut and dry. amazon gave him back his money and after the fact the guy says he is still using it and maybe will return it when he is done with it

potofgold23 12-03-2011 02:52 AM

if it is a legit item you can certainly call his local sheriffs office and tell them you want to file Federal mail fraud charges

Looking for some advice on how to address what I think is a phony A-Z scam....
I have an amazon buyer who has put in an A -Z claim for what she says is a damaged book. She wants a full refund. I believe its a scam because of this: I sold the same title (a text book) to a person one month before with the exact same last name, in the same town, in the same state. I googled the address' and they are 9 miles apart. Bit of a coincidence huh......
she also claimed the book was damaged. I gave a full refund to avoid a bad feed back. I only have 10 feed backs on that account and a bad feedback would hurt badly. Two would sink me.
I think its either an outright scam, or this is another seller looking to trash my account. I have yet to decide what to do. Any thoughts on the matter would be appreciated..

Gamefreak 12-04-2011 04:17 PM

Thats the only bad thing about giving refunds. Once you do it ppl usually tell their friends. If I were you I would insure all items sent. That GREATLY prevents fraud/scams.

Good luck negs really hurt this time of year.

potofgold23 12-04-2011 08:17 PM

Do you also have a buyers account?

DHB123 12-05-2011 08:30 AM

Nope. No buyers account. This account is stealth all the way. I've been at the book game a long time, and I've seen every variety of scam artist. When i ditch this account (tax requirement) I will make sure Amazon is aware of what I believe they are up to. If they are my competition, I will eventually figure it out and nuke them. They must think because I only have 10 feedback, I don't know what I'm doing. A naive mistake, never assume your competition is an amateur also...

potofgold23 12-06-2011 12:09 AM

Open another account using the buyers details, engage in bad behavior and both the '⊗⊗⊗⊗' account you created with their details and their 'real' account will go down. Not sure if it works with amazon but it certainly does with ebay when buyers choose to be scandolous

DHB123 12-06-2011 07:53 AM

wow, that is soooo devious. Remind me to stay on your good side..L

rsot 12-06-2011 01:47 PM

Heh potofgold23 - devious but effective.

how does having insurance prevent fraud? they can still claim it's broken or whatever, no?

As I was reading this thread I remembered the xbox I ordered had not arrived from Amazon. I checked the tracking and it said "front door". Dang I never got that package (honestly) and I almost crapped my pants. I called Amazon and they are sending an overnight replacement no questions asked and call was over in less then 5 minutes.

Now the funny thing is I DID get one package that day, but it was the Kinect that I ordered separately. I did see the driver take off so I am 100% sure that the XBOX was never left at the door. I tried to explain to the Amazon rep that truly I know for fact that the driver never delivered 2 packages as I saw him climb into his truck. However the agent didnt really even want to hear the facts and instantly offered replacement overnight.

So in this case A-Z did work for me as it should. However they should of at minimum listen to what really happened. Because obviously it never made it off the truck.

Gamefreak 12-21-2011 03:29 AM

you cant file a-z claim against amazon... thats for 3p sellers only.

It protects you because its a felony to file false claims or something like that but its not good for buyer if their lying.

Yes that makes sense... I am just glad Amazon believed me or policy is to believe me. I do shop with them a lot. Last years and this years Christmas was almost entirely Amazon. I love Amazon prime.
