Register a brand
 
Hi everyone. I saw a item on Amazon US. There is a Chinese seller put their factory name and said this is their own brand product. But I check on the uspto , it does not have their record. If I go ahead and register the brand name. Then I can take over his item listing and sell his brand's item ? Is it work ? Thank you very much everyone. :hail:

doL - OP hasn't said that.

Apple sell iPho/ne chargers and other products. Garmin also sell iPhon/e chargers, doesn't mean they have stolen anyone's business.

Maybe I'm misunderstanding, but it certainly sounds as if he wants to highjack someones unregistered brand name from them. I guess its not exactly stealing someone business, just the name.

If you register a brand name you do not own, there can be legal consequences.

Your plan is flawed, not only because it is shady, but because you are expecting this other seller to just go away. And they may be tied to the brand owner, you cannot tell that from a USPTO record.

Why not buy something generic and come up with your own brand name? You can't stop others from selling the same generic item, but if you create your own brand name, then you will be the only one who can use the name.

I agree with Jeff on this one better in long run to create your branding it may take 1- 2 year but in long run you will be the only one selling that item . It took me 2 years to build my brand and I do about 100 orders a day just on me branding my own product

Thank you guys, thanks for the suggestion. I will register my own brand now.
Just another questions, if I did not register my brand and sell on Amazon say this is my own brand. But other seller register my brand before me, can they report to Amazon say I am not the owner and kick me out ?
