Repeated Trademark Infringment
 
We dropship on Amazon and are able to keep our metrics in very good standings. The issue we keep running into is since we are drop shipping, trademark owners are reporting us to Amazon and after so many violations our accounts gets suspended.

My question is since we are purchasing the inventory from an approved source (not direct), what can we do to avoid these repeated trademark infringement claims? The policy warning from Amazon states to contact the rights owner but 99% of the time we do not receive a response.

How is anyone else responding to these claims or what is the proper response to Amazon to explain the claim cannot be verified? After 3 or 4 claims, our account ends up getting suspended.

If you aren't being approved by the Rights Owners then there's nothing you can do....

Get permission from the trademark owner to sell the items

Or find a new items to sell

The problem is we aren't aware of this until after it is already too late and the policy warning is received.

What would the best response be to Amazon concerning this as they state in their warning that they do not investigate this and cannot prove any infringement actually occurred.

Best to get their permission before you start selling their products in that case

That would prevent you running into this issue

amazon is a free market place to sell anything you want, think about it if I purchase Nike shoes that I don't want anymore , why can't I sell them? If they are actual Nike shoes there not counterfeit why can't I sell them? It doesn't make sense and from what I got from Amazon is that if you don't receive communication from them don't take off your listing, the other competition in your listing is trying to get you off the listing, but if you can prove your source to Amazon when they ask for it why are you ever going to run into the same issue? I

I agree with it being a free market but the trademark owners may not want you selling their items on Amazon.

Amazon automatically takes the listing down once a trademark infringement claim is received. They do not ask for any copies of any invoices for a trademark violation only that you contact the rights owner to resolve the issue. 99% of the time the rights owner will not respond to our attempt at contact.

You need to prove they're genuine, I had the same a couple of weeks ago easily solved as my items have authenticity codes on. They don't care about 'trademark owners', they sell items without permission themselves

While 1 person is trying to sell their real Nike shoes on eBay/Amazon ect there are another 5 trying to sell ⊗⊗⊗⊗.

Because of that the people who are trying to sell their real items are getting caught up in the hunt to stop ⊗⊗⊗⊗ being sold

They 1 - Dont want to open themselves upto a lawsuit and 2 - simply dont have the time to investigate ever claim that something is ⊗⊗⊗⊗ or real. Its much easier for them to just remove the listing and be done with it

I understand this also but is there something to respond to the policy warning as to claim no fault or at least not have it count against you?
