seller trying to claim ownership
 
seller has his own listings, some of these products are branded, he cannot own them. They are minor Uk or usa brands for specialist use eg. car care (it's not car care)

so he has put his store name or just random letters numbers on title.

he has used pics from a website that I or anyone can buy them from.

so can I list under his adverts?

need more help on this.

just got second set of threathening messages from original lister.

This lister is using photos of my supplier. It is my supplier that is the brand owner on some (like an own brand, in house brand) and others there is a brand owner eg. nike (not nike, you wouldnt have heard of them, but they are a brand) - so the lister is catagorically NOT the brand owner.

so I want to reply back, for them not to email me again. I also want to inform them that it is actually THEM who is a brand infringer by using the brands photos and claiming as their own. I also want to tell them that I will report them to the brand (who may not know about it) and then we both wont be able to sell them!

will this scare them off?

or am I not allowed to list under them regardless, if they object? Am I wrong to step on this guys listing made by them.

this person was expensive, I come along and undercut, I get that he is annoyed - but people do it to me ALL THE TIME....

What exactly is he threatening you with?

It sounds like you already know what you want to say to him, stand your ground and dont let him bully you into not selling your items, as you say he is not the brand owner.

Otherwise be the one to contact amazon first.

Just send an e mail requesting for his trading address and his lawyers address as your lawyer needs serve something on him. That should make him quiet

I should think Amazon would side with you. Amazon did not want their pages to look like eBay's pages, with a million repeated listings for the same product, so they want 1 page per product. The people who try to make a listing their own are interfering with this. I see it all the time - I'm searching for an item and 12 listings all come up, for the same exact product.

It is one thing if someone creates their own product, but ordering someone else's product and claiming an exclusive right to sell it is bull****! I have had this happen to me, and I simply ignore them and have no contact with them.

In this case, I would not contact him, but if he tries anything, I would immediately notify the brand owner and provide the brand owner's information to Amazon. But I have a scorched earth policy when dealing with these morons. They are always in their late teens or early 20's and they THINK they are brilliant, but the reality is they are just sleazy.

I reported it and we are both blocked from some listings, which I dont really care about...and the rest are ok, and seller has not messaged me since.......hopefully they got taught a lesson.

find it hard to differentiate between different rules though eg, some have stock photo and some have their own pic , taken by themselves, avoiding those, although in theory I should be able to list under them too, as it is a product I can get a hold of.....

Ignore him. I learned long ago that replying to these idiots only fires them up even more.
Amazon has made it this way and if they created a listing to an item that already exists then that is there problem....

Example I list under Seagate and sometimes undercut them and they are not having a fit.
