Trademarked Listings for Generic product
 

I notice some good listings that I can sell generic items on, but there is only one seller and is he has put a TM or R Symbol on his listing.

Does Amazon verify that they actually have a Trademark for this item if another person sells on their listing and they complain to Amazon that you are selling on there listing?

no the seller will contact u after you list the item and make threats or send a letter then they will contact amazon and amazon will remove your listing.

So why doesn't everyone create their own listing and put a TM or R in the title and do the same.

cause it takes a long time to do what they do thats why they don't want anyone to piggy back onto their listing.

u can do it yourself and you will see the reason why they do it. it pays off though as they make a killing but it can take months to get your listing ranked to be making any money

amazon will ask for evidence.

do you know what sort of evidence they provide?

I don't think Amazon will seek evidence, if the seller was the one to open the listing themselves, and build it up.

On the other hand if they do, you can easily provide your trademark registration paperwork. Stuff like that are publicly available in the UK, to avoid people registering similar trademarks etc.

they normally ask following

If you believe sellers are listing against pages that do not exactly match their items, please reply with the following information:

1. Amazon Order ID of a test buy that confirms the violation (required)
2. A description of the differences between the item ordered and the item received (required)
3. The ASIN/ISBN of the item's detail page and the product title
4. The store or business name of the seller you are reporting
5. Any other evidence that supports your complaint

If his brand is on the item, you cant list on that listing, but if his brand is on the listing and not the item, you can list on it.

He will try to threaten you if thats the case, and you can report him for violating the message policy.
