Amazon ... Exclusive selling rights need help
 

Hi i have been selling a product on amazon for about 2 years. For the first year and a half it was very good it was mainly only myself selling i had the buy it now and it was all good. However in the last 6 months we have had Chinese sellers come and reduce prices so it seems its a battle to the lowest price. However there has been a little twist the right holder who owns the trademark for the brand name in uk and europe is willing to give me exclusive rights to sell this product on amazon so with a letter from the right holder will i be able to get these other sellers off and if so what do i do. Do i email amazon and if so whats the procedure to get the sellers off as i am likely to get exclusive rights. Any advice and help would be appreciated.

I believe the rights owner would need to contact Amazon to request them to be removed.

Ask right owner to report using this link https://www.amazon.co.uk/gp/help/reports/infringement
It does not matter if you have exclusive rights or not

If he gives you rights then he could give you an authorization letter also assume the role of reporting those that do not have the rights.

There are about 5-6 different sellers by reporting it will the full ad go down or will only those not authorised to sell go down.

In addition will a trademark of the brand name be enough to get sellers off as thats the intelectual property the person with rights has.

No only the one you will report, u cant remove item since its permanent catalogue in amazon system

when you put ASIN in this form it will give u full list of current sellers, from here you can select sellers which you like to report

You would also need to to a buy test to get those people removed. To show that the item they are selling is not the same one as on the listing.

they are listing the correct item but they are not authorised to sell the specific item due to trademark.

Are you certain the same rightsholder offering to give you "exclusive rights" is not going around saying the same thing to other ppl?

i am sure as i will be purchasing direct from them. plus the other sellers are chinese sellers sending items into amazon fba

Interested to see how you find a resolution to this.

By the way, make sure your FBA settings you have "commingled" turned off if you are also FBA (before you send in inventory). Otherwise your inventory gets mixed in with these chinese sellers inventory and if they are selling counterfeit and a customer buys from you with FBA then Amazon might sell the other person's commingled inventory under your name and you get in trouble.

I wonder if this one of your competitors setting you up.

Seems strange he got that far getting a product to market and doesn't have a friend or associate, anyone who is not a stranger, sell his product for him on Amazon. Something seems fishy :spy:

True you have a point. In fact this guy is not
The manufacturer but has the trademark registered on his name
In uk and has told me if manufacturer is ok with it hewill
Give me rights to solely sell on amazon if i take the goods from
Him.

To be honest only thing i am worried about is that if i get the rights will amazon remove the other sellers from the product on amazon

Other people can sell the item, I just tried to sell an item that the only person selling it was the company itself. Got a notice from Amazon that it was removed. Can't recall the exact wording... but my item was up for sale for about 4 days until it was removed

Sometime amazon put on auto list to remove the item

the rights holder has filled the form out and wrote that certain sellers do not have rights but what is the procedure next how long do amazon usually take.

it has been nearly 48 hours amazon have not contacted back and not removed the sellers how long do they usually take and what do they look into?
