Amazon Seller using their seller ID as brand name?
 

I've had a cease and desist letter written to me from another seller for selling on their product ASINs. They've created thousands of ASINs with many widely available products including selling products with Brand's trademarks which I am sure (but not certain) they don't have the rights too (I'm not selling on those ASINs in any case).

The seller has now done a test buy on a number of products in question from Amazon FBA, and has already told me they will open a claim on the products to have me removed from selling them.

Will this create a performance notice and count against my account? What is my best course of action?

If it's purchased thorough FBA he can't open case

But what he will do he will report to amazon that item is different then what is advertised on listing which is quite simple anyone can do this
Next he will return item back to amazon

Job done and you will get warning from amazon
As you said he purchased many products this mean u may loose your account
