Adding your own Terms & Conditions to an eBay listing
 

I do this and I'm sure a lot of other sellers do this, which is to add your own Terms & Conditions at the bottom of your eBay listings.

I do this to try to protect myself against difficult or fraudulent buyers, leveling the playing field so to speak.

Examples:

"Seller is not responsible for loss through Australia Post"

"Actual product may differ from picture"

"The liability of the Seller is limited to replacing or refunding the cost of the item"

I'm wondering what disclaimers or T&C's some of you other sellers use or recommend using.

These types of T&Cs are a waste of time. Ebay determines the T&Cs - not the seller. You can state whatever you want but it will have no bearing on the outcome of any cases etc that get opened.

Your first example - the seller is ALWAYS responsible to ensure the buyer receives the item. If the buyer doesn't receive the item, the seller is liable to replace / refund. It would then be the seller's responsibility to pursue the loss with Australian post.

I understand your point of view but I don't agree entirely.

Yes, eBay determines the T&C's and having your own is unlikely to assist in a case, but having your own T&C's could reduce the amount of cases to begin with. Some buyers may deterred from opening a case because of T&C's and I think certain T&C's would deter some fraudulent buyers.

It's a nice idea but in my experience buyers rarely read a listing description properly, let alone T&Cs.

Posting Terms and conditions is nothing more than a bluff. If it keeps a buyer from doing something like wanting a return etc...then it worked. But that's all it is....

even if you post no returns they can still return it. Ebay does not care about your T&C.

Basically I sold a 11 piece toolset. in my description i wrote its 11pcs and photo also showed 11 tools on it. I chose an option not to allow returns. Buyer opened a case that 1 tool is missing because he was expecting 12 piece set. After escalating to eb customer support they stood on his side. So I had to give the money back but since CS resolved the case they get to keep 10% from fees while I give all the money back to the guy. I lost 30$ fees + 20$ shipping on that transaction...

I agree totally that T&C are a complete waste of time for sellers. I had my listings clearly state item must be picked up within 3 days from purchase or seller could relist/resell with no refund as it was local pickup only; 14 day return policy stating item returned in the exact condition at pickup within 14days from purchase plus a $2.50 restock fee for any return. Buyer claimed "item not as described" I asked buyer to return item per my conditions and I would provide a refund. Buyer refused to return and then changed his statement to item not received. The claim was made 2 weeks after purchase. I responded that my listing clearly stated local pickup only and had to be picked up within 3 days from purchase. eBay still granted the buyer a refund. So T&C means nothing.
