HELP! Purchased 'business-paid etc. Seller then re-lists again! Allowed?
 

Hi All

I purchased a business at the end of March 2016! Yes only a couple of months ago and now the seller is selling the same product same listing again.

Is this allowed? I have looked at reporting the item but all the drop down menus don't seem to relate to this problem.

Surely this practice isn't allowed? Had I of know this of course I would not have purchased.

Can anyone shed any light to the best way forward?

Same question as PolMart...Did you buy a business and its physical merchandise? or did you buy an ebay business with some suppliers?

From what I can tell you have purchased a eBay account from someone who sold X item in March

They have now made a new account and they are selling X item again

Have I got that right?

If so there is I am afraid not much you can do about that unless you have a contract with him in which he barred himself from selling X item for however long. If you do then it would be civil action you take against him through solicitors.

Sounds like a business in itself.
It would come down to the same thing though. Contract stating he can't?

What sort of contract did you exchange with the seller about future sales?

Did you have legal advice when you made the purchase?

Best way forward is to have your contract of sale checked by a person qualified under UK law.

Forum does not give such legal advice.

You would need the contract to have a non compete clause as yankee indicated and THEN you will need legal advice...GB said it correctly about forum not giving legal advice.
