If they go legal - you go as well and decline anything they might say. There is a presumption of innocence, so if you say that you never ordered any foo foo goods, they will have to prove it somehow, that it was you, who ordered these goods, and you did that on purpose. That is nearly impossible, so the trial will be most probably closed. All these "legal" letters are oriented to scare you to death, so you would pay them, when in reality they should do a lot of work to prove that you are a bad guy.

As I'm sure that you're already aware, nothing on this forum should constitute legal advice, however...

A similar thing to what you are describing may have happened to a freind of mine and in that case ignoring the matter seemed to make it go away.

It is best not to respond to customs, as they are unlikely to take any further action other than to notify the owner of the intellectual property (which they've seemingly done already, hence the contract from the brand company) and to (eventually) destroy the item.

As for the deed of undertaking, I would be inclined not to respond. My philosophy would be that these matters are typically too expensive for the intellectual property owner to persue with too little to gain for them to bother with persuing the matter further. Their tactics are likely scare tactics designed to deter and in this goal they seemed to have been successful.
