Civil Action - need your advice

Hello.
For the last 3 month, I have been selling a specific item, which only now I discovered to be f a k e.
3 month ago I found out that a large wholesaler, which I known for a long time before, is selling this item for a good price.
I contacted them and they said the item is authentic, but comes without warranty.
I have decided to order one unit to test. The item came in a perfect condition, and I was 100% sure it's original. So I started selling it on both EB and iOffer. I was drop shipping them, never had physical stock except of the one item I ordered for testing.
I never had the listing removed, on both website. All buyers left positive feedback etc.
Today, I got a strange email. It is a copy of a lawsuit, between the original company of this item and my supplier.
Then I understand something went really wrong. I went to my supplier's website, and found out the specific item it not for sale anymore.
I contacted them, they replied very fast, and said "I shouldn't worry". They won't reply to the fact that they lied to me in the first place.
Then I thought why did I get the email and not them? I opened the file attached to the email, and found out that they have collected email addresses of people who were drop shipping the item from this supplier, and sent the email to all of them.

My name does not appear in the "defendants" section, but the document says that since they have been unable to locate the true identity of my supplier, they are sending the email to any address they found.

Here I need your advice. I have cancelled all recent item I have sold and refunded. What else can I do? I do not want to be held responsible for my supplier's false claims.
Also I have to mention, my listing of this item was not removed at all. I have ended it myself.

not an expert in any sense of this matter

but if it was me...i wouldn't worry

as you said you was led to believe it was authentic

do you still have the emails from the shipper telling you the item was genuine

ben23 12-21-2011 07:13 AM

Yes I still have the emails.
But do I actually have to come to the court?
Because my name is not written in the "defendants" section, but it was written later, in a section about email addresses associated with the supplier, ans also in a section about pp addresses.

If they have your real information, then you NEED an attorney. You have not been sued YET, however they CAN add you in if they want to.

I'm not familiar with the legal system in Israel, and do not know anything about your case other than what you have posted. But it sounds to me like you need some SOLID ADVICE from a professional here, not advice from a bunch of anonymous people on the internet. We can all try to be helpful, but we are NOT attorneys.

Sounds bogus how are they not able to find the company? You had to problems buying from them and getting the information.

If your email is all they have you dont have anything to worry about it seems. Unless they really want to go after you.

But like jeff said we are not attorneys.

In the documents, it says that the company, based in Hong Kong, used fa*ke names and address, and the only real info is the email addresses. That's why they can't find the company.
They have my email address but also my pp address. Can pp reveal my information to them if they request it?
I know you are not attorneys, but I trust the people here since I am sure several people here have experience with such things, and always give honest answers.

Go read the "shipping talk" sub form. Read it all the way through. You will learn a lot.

Do not get an attorney because you got a threatening email, seriously.

is this a stealth account ? do you have the email stating the product was authentic ? when dealing with suppliers keep everything, however that little nugget wont help if you didn't, if its a stealth then lose it asap just in case and start again...

rsot 12-21-2011 03:56 PM

Did not read other posts but with a title like that, you NEED an attorney - sorry if repeating someone else.
