Gladiator is totally right. In the US you can file a counterclaim and if they don't sue you, Ebay will reinstate your listing. Sadly, that's only possible in the US and not in Germany for example.

ebay are just a bunch of w*****rs.
i got pulled up soo many times with bogus companies.
emailing contact being gmail or hotmail.
in total, i spent HOURS, many hours talking to them and explaining how it's nonsense.
they just don't care or give a damn.
there was one guy, he was int he states, he had a hotmail address.
i searched him up.
he's a fraudster. and being sued by 3 different companies for IP rights.
i explained this to the manager of the manager of the first ebay agent i spoke to - couldn't care less - he's got a job and that's all he cares about.

do ebay give a flying f**k??
no. they don't.

i wish the world was fair and honest - it isn't.
i wish the world had common sense and care - when it comes to ebay, they don't have.

Anyone can really be a "VeRO Agent". Lots of ⊗⊗⊗⊗ ones as they use ⊗⊗⊗⊗ "documents" to convince eBay to give them the ability to pull listings.

You seem very fustrated and angry; you have every right to be. You need to think outside the box and rethink the way you do things to avoid this nonsense. eBay can't do much to help you, unfortunately.

You can't counterclaim Trademark removals. only copyright, copyright buse is rampant on ebay, competitors use it to knock best match sellers down. Because even if you file a counterclaim, your listing is still ended and you lose all the watches,sales etc.. it's so abusive on ebay.

This kinda reminds what me of the "flagging" that goes on Craigslist. The people who run the site will tell you it's a "self policing" community, but in reality it turns into an absolute mess.

eBay needs to carefully vet & screen VeRO agents. Even then, one could still get past that verification by sending in forged docs. When lot of money is on the line, those competitors will resort to just about anything, even if unlawful to get an advantage.

I deal with a big time liquidator in miami, i stopped carrying their products. Not worth the hassles. If you own a brand, you can block all competitor on ebay or amazon etc.. if you choose to. I understand the need to stop foofoos, but the honest seller gets the shaft.

Have you reached out to them? If you’re getting it from an authorized seller you should get them to whitelist you.

South beach isn't whitelisting anyone. I had an ebay rep email me ask me to sell stuff under their next sale, and i'd be featured under the particular sales event they are pushing, which i think is ongoing right now for beauty skin care stuff. i told her, i have lifecell that i could offer customers, but i am afraid to list it, if she would guarantee it not being removed. I'd do so, but she said just rech out to xxx team, and it just wasn't something i felt like dealing with, at that time my amazon store had taken off. I may think about it as the summer slow times hit,

Sometimes the EB agent will make up a rights owner that doesn't exist. What was and always is a competitor complaining to EB enough to have them take a look. What happened to stop this was I found out EB was linking me to other accts not even selling. I came here for some help and I found what to do (thanks all x 1000 over the years)....they went away to never again flag the same items.

You don't need to be an officially registered VERO member in order to take a listing down. All you need to do is to email vero on ebay and tell them that you're the owner/representative of brand X and that listing XXXXXXX violates your IP/trademark property rights. They'll comply. I know this 100% from reading a recent case.

I wasn’t registered with VERO for years and all I did was email the IP/VERO team. Legally all ISP and Webhosts have to accept any reports by fax or email. Vero makes it faster but it’s not required.

This is true but this has been abused. Over time they will let some semi-vero's list but if they don't like your listings they will find (phake) vero's or just pull them cause they can. Mostly at Xmas they get away with pulling non vero items if you have a sh^t load of them listed or/and for stupid prices etc...

Unfortunately, this has been abused for years. We recently have some listings removed by the "agent" of youtube, using a yahoo email address, claiming copyright infringement....:|
