Sold a phake phone case to an attorney in NY??
 

I've been selling phake branded iphone cases successfully for 2 years. Recently I noticed that there's one particular buyer making a repetitive order actually his second time. The first one he received the item but no feedback left. a couple of days after He came back and re-bought it. This time I went onto my paypal app checked his mini-profile picture and name. My first thought based on the picture he looked clearly an attorney quite descent face with tie and suit his name and lives in the same city as me. Anyways, I immediately took down the listings and refunded him. Am I in trouble?? serious answers please! Thanks!

Also when I shipped the item to him I used a stealth address.

I you knowingly sell items like that you don’t really get to complain when it catches up with you... only time will tell on that front

lol oops. They probably have a paper trail on you. Probably told ebay to let you sell them to nail you.

So the thinking is that this particular guy who happens to live in your city and 'looks like an attorney' is trying to entrap you in order to sue you on behalf of apple for selling ⊗⊗⊗⊗ iPhone cases...?
Do you really think apple doesn't have better things to do with its time? Do you think people can have a certain look and NOT be lawyers? And no offense - but do you really think the world revolves around you and your ebay sales...?

more than likely just a guy who bought the item thought it was nice and bought another one for his wife/girlfriend/family member. Stop overthinking things and stop with the paranoia. If this is your way of thinking then definitely drop the ⊗⊗⊗⊗ goods cause with that attitude youll give yourself a heart attack.

Probably the most true answer. Chances are, they would send a VeRO takedown, and leave it at that.

Unless you are selling like 100k in these phone cases, then you may have an issue lol

Time to start peeking out your window to see who knocks on your door.....cause one day it may be a certified letter from a law firm, best stop.....and if you do get something from a law firm, I hope you have money saved for all your legal problems.

I'm here for help and not having someone to dig me even deeper!

I already removed all listings related and even made my feedback private. I reckoned that it was a risky move to sell those but If i had just a tiny grain of hope that I can get away from it then I won't ever do it again ever.

Its just the risk you run if you sell this stuff, I wouldn't worry until you get an official email/letter. I would not recommend creating exact clones of items from these big companies. They do not own the rights to all phone cases so maybe do something similar without copying exactly. Be clever its best to make less money for a lifetime than a good 3 month run with a lawsuit at the end.

How do you know this guy is even a lawyer? Even if he was an attrorney, why are you scared? Do you have something to be scared of more than admitting on this open forum you sell "foo-foo phake & phoney" phone cases?

If you really want to find out just go to the state bar website this guy is in and search for his name.

BTW, lawyers are probably not likely to order your listings to "entrap" you like this. It was probably just some dude looking for a phone case.

Don't sweat it. That happened with me before and all turned out fine.

If a lawyer from a law firm wants to make a test-purchase, I wouldn't think they would put the word "lawyer" in the shipping address!!


Btw, did you ship the items with or without tracking? Cuz if the buyer didn't choose a tracking service to get the cases delivered, he doesn't even have a case against you. You could simply deny the fact that he got anything from you delivered.

Tracking doesn't prove much of anything by itself. Even a lawyer is going to need a LOT more "evidence" against you simply than receiving an alleged "phake" item in the mail. Who's to say it's a foo-foo item to begin with? Is there an expert on phone cases ready to receive the item at the time of delivery? With this logic, anyone can send an item to someone claiming to be anyone. Who's name was on the package? What did the package actually contain? What's the "proof" of that?

The problem is people are overly paranoid about stuff like this. Actually, there is good reason to be if you are doing something that is potentially "illegal". The law is complicated and things are not quite as cut & dry as people might think.

Yea, he's a lawyer. So what? He probably wanted a good looking phone case like the one you sell. Not a big deal.

His practice areas are: No fault defense, real estate, business law, litigation, and social security disability. I would be more concerned if one of his areas was Intellectual Property/Trademark/Copyright/Brand Enforcement, etc. Even then, it's highly unlikely they would be making a "test buy" like this. It just doesn't make sense on many levels.

One other thing: You already admitted to selling "phakes" in this thread. You are best advised not to do that again, whether true or not. Keep in mind forum rules discourage discussion about this topic. The less you say, the better.

Funny thing is the lawyer working as a Vero agent would not need to buy a 2nd one. I think you was fine and he just wanted a 2nd case. But if selling it makes you that nervous and paranoid then you are probably better off not selling it. It'd suck to give yourself some type of ulcer or tumor over selling stuff on ebay.

I will start changing my low-life selling habits and find something else better on the run. The only thing i'm still afraid of is whether he can track my information through eBay. Maybe he would reach out to them tell everything I've been doing and exchange my personal info. Anyway i'm still overly paranoiac haha sorry...

I doubt he is after you. However, if you get an email from him, dont open it. If you are getting certified mail, be sure to see who it is from before you sign for it. And dont sign if you dont know who it is.

Copy that sir! I'm glad I didn't use my real name and address when it was shipped to. And also changed all my ebay account information.
