proof ebay does strange things..
 
I had an auction up selling a T-mobile sidekick cell phone. I used all of my own pictures and wrote my own description. My auction was ended and I got this in my email:

The rights owner or an agent authorized to act on behalf of the rights owner, T-Mobile Inc., notified eBay that this listing violates intellectual property rights. When eBay receives a report of this type of violation, we remove the listing to comply with the law.





Your listing was reported for using a brand name without the right's owner's permission.

It's against the law to use someone else's trademark -- the unique sign, name, word, phrase, logo, or symbol used to identify a product or service -- without their okay. It can also confuse buyers about the source of your item or your relationship with the trademark owner.

You can use a company's brand name or logo in your listing description only if the item you're selling was made or authorized by that company.
This is the sort of BS that got me banned the first time around. Should I email them and try to set them straight, or would this just call un-needed attention to my stealth account?

I find it really strange, Ive sold many used phones, unless it is widely copied like iphone its strange, is it new? Its the rights owner email though, I wouldnt mess with them normally but if you have some proof of purchase it may be ok to email them - its really unfair. I agree though, sometimes annoying them about real goods, can get you banned, happened to me too, although they didnt admit that was the reason obviously, some goods they just dont want listed even if genuine..

Same type of situation that got me kicked off too.
WTF? what's next want to sell a Cadillac Escalade, but you can't use the words Cadillac or Escalade?

^^^Not such a good example. Surely if the car's a Cadillac it would be sold in ebay motors? If it's an item associated with a brand name, then the listing would need to be carefully prepared. The rights owners can be nasty:we all now that :peace:

Often those messages don't contain the contact info for the VeRO member. If that info is missing, then you was ratted out by a competitor, not the VeRO member.

If it really was a VeRO member, about halfway down the email, there will be a contact email address or phone number.

same thing happend to me so i tried to fight it... that was a big mistake... my accout was susspended and then my funds were frozen. well thats why i always have a back up

lost about $200
