Appealing a return case for a restricted account
 

Hello,

My account was hit with a MC011 suspension about a month ago for too many canceled orders. A buyer opened a return case in which a return label was issued. The buyer did not return the entire item and we have our original tracking number and return tracking number that shows a 100lb difference. Ebay is not allowing me to appeal the case because the account is restricted. Anyone have any tips for me to get my money back? Maybe I need to contact a different department?

You might need to file a police report and fax that in with a demand letter to eBay's legal department.

Depending on the amount of money involved, you also might want to file a small claims action in court for the money in question. Some people have had some success with that option.

I had this same issue, however they never sent it back, and ebay sided with the buyer. They said that :

"Once an account is suspended, you are no longer covered under the eBay Seller Protection"

Which seemed like BS to me.

If you take eBay to small claims, the best you can hope for is that eBay will settle with you so they don't have to goto court which for them would be far more expensive than just paying you to go away.

On the other hand, if you do file a claim in court, it will come down to the "contract" and "user agreement" you had with them. You would need to convince the judge that eBay owes you the money, and why.

I have no idea how much money you lost from this buyer who obvious scammed you, but you might just need to write it off as a loss. This is going to be a tough case.

Around $92 so it is not enough to lose sleep over just annoyed. So I will file a police report and send them an email with the screenshot and description stating I will take legal action?

Some experienced people on this forum had suggested filing a police report which only serves as documentation there was a report of fraud by you. The police themselves are very unlikely not to do anything in this case, but having that report is usually the first step in showing eBay there was a problem.

I wouldn't threaten eBay with a suit if only $92 was involved as this likely will cause them to shut down all communications with you. The only problem is your MC011 suspention, but it's worth a shot.
