Default Listing Removed - Trademark Violation

Hi,
I was selling Adidas Clothes and my listing was removed 3 months ago due to opened 10-15 returns. My question is; can I list again the same item as I am sure this time I won't get any single complain from the customer? Please see the below email and advice.

You would most likely get your account permanently suspended if you relisted the same item.

With that email, you can bet that you are now under the eBay microscope.

This means it would be laughable if you even tried to re-list. If you are going to do that, kiss this account goodbye. They'll slap on a MC011 selling restriction, you can be 100% sure of that.

Please answer the following questions:

1. How many items were sold via that listing and how many return requests were opened?

2. Did buyers chose "Item seems to be not authentic" as the reason for their return?


I guess the high return rate is what got the listing taken down.

There is nothing wrong with the item you listed I guess, it is the way it was listed that got the auction removed.

If you now have a good plan on how to list without getting taken down again, I would give eBay a call and try finding who filed the report against you first. If it really was a law enforcement agency, then don't ever think about using that account for selling Adidas merchandise again. If it was merely a buyers issue, then you could try your luck and work it out.

Vero can just look at the pictures and decide it is counterfeit.
or a manufacturer rep looks at it and either have the authoirty to remove your listing or ask Ebay to do so

AMZN has allowed and invited manufacturers to remove listings themselves instead of reporting to AMZN and ask AMZN to remove

If it were either the manufacturer or a VeRO rep it would have said that in the listing takedown email, and it would have given contact info for whoever submitted the report.

In a VeRO email, it doesn't say this part :

Instead it would be like :

I think the OP was correct in their assumption that this listing takedown resulted from too many returns and/or buyers reporting the listing.

I guess the high return rate is what got the listing taken down.

Approx 200 items were sold on that listing and around 15 return requests were opened. I am sure that the listing was removed because of too many return request opened as 2 of my friends were selling the same product and their listing were running fine as they weren't receive any returns.

If it was the VeRo, they would tell you and give you their contact info to discuss with them if you think your item was falsely removed. I also don't think its an issue with other people reporting you. If that was the case you would've had to have quite a few people report your item before they removed it (not the case with newer accounts). IMO your issue is definitely with your returns. Why are you having so many returns on authentic items? Also what is the reason they put in the return? Obviously if your getting lots of returns for "unauthentic item" it's gonna cause red flags. I'd suggest figuring out what you need to do to make sure your customers are satisfied before doing anything. Your gonna have trouble making it on any account with that return rate. Best of luck!

Also I can tell from the email that this is your 1st warning correct? Just wait a week or two (sell other low risk items in that time) and change up pics and wording in your listings. The worst that will happen next time is you'll get a 7 day suspension. If you sold over 200 before getting a warning I think you'll be fine. Also if your gonna continue selling high risk items, DONT relist them. "Sell similar" and change up a couple words in the title.

Listen... your next suspension could very well be a 30 day or permanent.
play with fire , you'll get burnt.

The brand you mentioned is highly risky. It's not a ⊗⊗⊗⊗ colgate toothpaste you're selling here, it's ADIDAS. They are like a rabid dog.
