Fighting VERO Partial Success
 

Recently fought a VERO for trademark infringement. Went back and forth with Ebay before the VERO mark was removed and Ebay said I could relist the item as long as I used my own images. They are claiming the VERO agent made a mistake and it was a copyright issue with the images. Well, the owner does not have copyright on these images, have I won this case if I relist? Ebay gave permission to relist so long as "I took my own pictures".

The same thing can be done with a Counter Notice.

If you got a VeRO notice and have written proof of authenticity from the manufacturer, send a counter notice to the name/address on the notice. A receipt is not proof.

Without such proof, you will lose and can/will be held liable for legal fees, plus a substantial fine for each infringement. So, don't blindly send out such a notice UNLESS you are 100% sure you are not infringing.

An IP rights owner does not have to prove anything. Read the notice carefully. They suspect an infringement.

When you got your Vero email, was it an inauthentic complaint from the owners or was it clearly the images that they are complaining about?

How do you know the rights owner will not make that same mistake again?

When it comes to Vero, eBay only takes down. There is nothing eBay will do to try to keep your listing up. As soon as eBay receives a notice from someone claiming you are infringing their rights ---> eBay takes down and no question is asked.


Stay away from Vero and you will thank me later!

First was a complaint that the item was counterfeit. After I emailed EBay VERO, they said they removed the VERO strike b/c the agent made a mistake and now the issue was with the images. They said I can now relist if I use my own images. Well.. the stock photos are not copyrighted, I have rights to use them. This Vero agent is on their last leg IMO.
