Auction removed! - AFTER it had ended!

I recently had an auction taken down for copyright violation blah, blah but the auction had already ended days ago and I took down the description and pictures a couple of days after that. This just happened. The only thing that was left was an innocuous title. How can ebay take down an auction for the reasons they stated when there aren't any pictures or a description? That makes no sense.

Ballsack 09-28-2007 07:18 AM

They'd have to cache my images if that were the case.

Chris Hanson 09-29-2007 11:54 AM

They just did the same thing to me. After my auctions was finished they deleted them after they ended and told my bidders not to pay.

Ballsack 09-29-2007 01:53 PM

How can they pull my auction for reasons of copyright when there aren't any pictures or even a description to use for probable cause? Get me? What exactly would they be going by?

Chris Hanson 09-29-2007 02:12 PM

Auto bot do it or other users report you which will bring out the auto bot after you..

Ballsack 09-29-2007 02:32 PM

Doesn't a person do that?

Chris Hanson 09-29-2007 02:35 PM

Nope , I dont think so. I think they have a bot and a person too.

x2ruff4u 09-29-2007 03:21 PM

A person does the copyright emails. The bot is the one that searches for listings after you put them up. Bot finds something suspicious doesnt know what to do. It gets to the ebay employers desktop and he decides what to do.

What I think of how this process works.

i understand u could have hosted the images somewhere and u could have removed the images from ur host so it was not showing up... but how come u can remove description/text from ended listings??? this is JUST NOT POSSIBLE

Ballsack 10-07-2007 11:08 PM

It is the way I do it.

powerbid 10-07-2007 11:14 PM

Ballsack... how can u remove text description from ended listings? can u explain?

imjustme 10-08-2007 10:05 AM

I dont think you can change ended listings...? Otherwise I could sell a car to someone and then claim I sold them bubble gum for 20k!

powerbid 10-08-2007 10:56 AM

ABSOLUTLY NOT!! u can change images if u hosted to ur own server but not text

yes ive had that happen and it causes so much hassle, sometimes they do it after the item has been sent then the buyer does a charge back thinking theyre not getting it.

I have another take on this. How can eBay remove a listing POST auction and tell the buyer not to buy. As far as I've read it, eBay auctions are LEGALLY BINDING contracts. Are they not? That is what they tell you before you bid and I can't think of a reputable auction house that will cancel a closed auction after the fact. Is there precedent for this?

GreenBean 03-17-2008 05:02 PM

ebay is not an auction house. It operates by its own charter. Applies its own
rules. Think vero, unpaid fees, anything that may be trouble for them. Not the
seller.

anderson2016 03-17-2008 06:04 PM

GREENBEAN: I have no doubt of the power ebay bestows upon itself. However, if an auction is a "legally binding contract", then by its own definition, it can only be canceled through legal avenues. Not by an arbitrary decision on ebay's behalf.

GreenBean 03-17-2008 06:16 PM

The catch is that when we/you/me accepted the user's agreement, ebay's
rules are meant to be followed.... even though we find that they are unreasonable.

GREENBEAN: I understand what you are saying. But ebay's rules are 1000 times more elastic than the U.S. Constitution.

Please show me the ebay definition of "abusing ebay", since that is their favorite suspend able offense.

I tell you now that you won't find it. I also have not not been able to locate the section of the user agreement where I agreed that ebay could arbitrarily void my legally binding auction contract for ANY reason whatsoever.

Does anyone know if ebay has been challenged on this point yet in court? Or, perhaps, it was a seller going after a buyer who decided not to pay after receiving the email from ebay stating the auction was canceled?

anderson2016 03-17-2008 06:27 PM

MODEE: Very true. Ebay likes to scare people into arbitration. Then, when they realize they ran up against someone who knows the law and forces them to court, they settle and claim no fault or don't show up. COWARDS!

GreenBean 03-17-2008 06:33 PM

anderson2016, you are SO correct. There is no wording at all. My comments
are tongue in cheek as I do believe that ebay uses up people like scammers.
