Buyer states received empty box
 

If he opens an item not as described case and I send him another, will the case automatically close when the tracking indicates delivery? Or is that only for item not received cases?

No,INAD is not about tracking,it is about item not as described.
IF case is open on Ebay,follow the Ebay rules when you correspond with him,

If the buyer said they got an empty box, they probably want their money back. It is best to just refund and move along.

If you can, report the buyer to ebay and tell them to note it incase he does it to someone else.

With INAD,the seller usually ask the buyer to return the item and send him a return shipping label,once he used it,the fees would be charged to Ebay and Ebay will charge the seller account.
But in your case,if it is empty,no sense to spend money to have him return an empty box,so just refund him in full.
If you do nothing,he would escalate to get Ebay involved,and it will be one strike against you and erode your standing.
if insured,refund him and file claim ,ask him not to throw the box away.
OR
you can say i am filing claim and POSTAL crime investigator/ inspector will come to your house and ask a few questions and inspect the package,see if he will back down??

You already asked and were answered.
The answer again is - NO.
Delivery can be shown but the buyer is saying the item he RECEIVED was NOT as described - and THAT is the reason for the dispute.

I am not asking about the original delivery showing as delivered. The buyer wants another item, not a refund. I am asking if I send a second item, will the INAD case automatically close upon delivery of the second item or does the buyer have to close the case manually by telling ebay they are happy with the second delivery?

The buyer has to close the case, or ebay. However, everyone here is giving you wise advice. Sending a replacement in this situation will probably have you at double the loss.

Nice and clear - communicate with your buyer and if he/she isn't responding and trying to work it out with you, chances are strong you are being scammed and it's a loser buyer, sad to say :(

I bought something recently and it was INAD so I reached out to seller to clarify - seller didn't reply - I had to file INAD - then the seller started messaging and I worked it out with her

I'm pretty sure they are scamming me. They said the box was sealed when they got it and I remember packing this order. I was just going to send an envelope w/ a tracking number to their zipcode as 'replacement' to satisfy my requirement of sending another item. That's the reason I was asking if the case would automatically close if second tracking indicates delivery.

I think you should go back to Ebay and understand how it works,most cases are handled by robots.

Do not work directly with buyer on this case. It will only harm you (negative feedbacks plus defects)

Let buyer open item not as described case/item not received case and then work with the eBay case. If they do "item not received" provide tracking. If they do "item not as described" accept return and provide return label. When you receive back empty box appeal case that you received an empty box.

If box was really empty eBay will probably just screw the buyer. Then when they open a case in paypal, paypal will ask them to file a police report and once they do will instruct you refund the buyer.

You don't know what happened. Anybody can claim empty box. If this happened in real life the buyer would be eager to cooperate with authorities to find out who stole from them so they can be punished and it doesn't happen again. Scammer will say "I don't have time for this....".

So what if a buyer were to open a INAD case and returned the stuff for the seller; tracking shows delivered (Signed!) but the seller claims he never received it ?

Ooor, What if the seller said the box he received was empty ?

Who will win in these cases ??

yes seller can claim this and they will ask for police report then ebay will reimburse the money and buyer will get

if return tracking shows delivered,Ebay bot will refund buyer in full if seller does not do so,
if seller receives an empty box,he can get Ebay involved to look into it,like the other said,you will get to keep your money if you file a police report,Ebay will eat the loss.

Would this work the same way on PayPal only ? (so when you buy from a merchant directly via PP, this way eBay isn’t involved in the transaction !! )

Also, I was wondering how could PP / eBay verify those police reports ?
Is that even possible to verify a police report for a company ?

Paypal/ebay dont needs to verify the reports, once seller reported to police and it will be recorded on your name few cases will start investigating and you will get visit from your local police ��

this is not true in USA. Police don't care at all about this sort of things. Legally if you tell them ebay/paypal is asking, then legally they have to write you a police report. What ebay does is send that report to ic3.gov. Even ic3.gov doesn't care (it's possible the buyer is lying or post office lost it). It's like a tally system. Once they see MULTIPLE complaints about one person, then they might act.

Sold $400 item, buyer claimed "empty box".
Ebay asked for police report, then ebay refunded buyer.
Few days later I see a seller leave my buyer a feedback saying "be careful with this guy he will claim you sent him nothing in box".
Call eBay to rant (didn't expect anything). 'how can you let him get away with it', 'he's done this before, look at his 8th most recent feedback', etc.
Ebay rep cuts me off "sorry, don't mean to interrupt, but you are right, we only allow one of these per account. I've appealed the case. You'll get a payout in 24-48 hours".
Got payment from ebay $400 to my paypal two hours later.


Ebay knew this guy did this before. But once they found out I knew he did it before, ebay paid up. Ebay is the biggest scammer. I've never seen a company lie to customers face just to protect itself

have dealt with this kind of buyers. i've been doing selling on ebay for over three years with a stealth account and several ones. i can spot a buyer who wants free stuff. about your case, get a ups tracking number for the zip code of the customer and put it in the tracking for this customer. look at this feedback left for others, and as long as you have proof it'll be ok. second alternative would be to approve the return when you receive the"box" take pictures immediately, contact ebay, explain KINDLY the situation, be real super FRIENDLY to the ebay rep. they will send you an affidavit for you to sign,. scan and email back to them. wait about 48 hours and there it is... you will receive your money back! i've done it before and it works!

ebay has no way to tell who is telling the truth,but MBG kicks in and it tries to make both
sides happy.
But if your buyer keeps doing it,he will be restricted from buying as he is a hazard to the Ebay seller community.

On the other hand, lost quite a few of these cases. Best bet is use real account for big items and file police report. The only way to get your money back.
