But in your case,if it is empty,no sense to spend money to have him return an empty box,so just refund him in full.
If you do nothing,he would escalate to get Ebay involved,and it will be one strike against you and erode your standing.
if insured,refund him and file claim ,ask him not to throw the box away.
OR
you can say i am filing claim and POSTAL crime investigator/ inspector will come to your house and ask a few questions and inspect the package,see if he will back down?? |

Delivery can be shown but the buyer is saying the item he RECEIVED was NOT as described - and THAT is the reason for the dispute. |

I am asking if I send a second item, will the INAD case automatically close upon delivery of the second item or does the buyer have to close the case manually by telling ebay they are happy with the second delivery? |

I bought something recently and it was INAD so I reached out to seller to clarify - seller didn't reply - I had to file INAD - then the seller started messaging and I worked it out with her |

I was just going to send an envelope w/ a tracking number to their zipcode as 'replacement' to satisfy my requirement of sending another item. That's the reason I was asking if the case would automatically close if second tracking indicates delivery. |

Let buyer open item not as described case/item not received case and then work with the eBay case. If they do "item not received" provide tracking. If they do "item not as described" accept return and provide return label. When you receive back empty box appeal case that you received an empty box.
If box was really empty eBay will probably just screw the buyer. Then when they open a case in paypal, paypal will ask them to file a police report and once they do will instruct you refund the buyer.
You don't know what happened. Anybody can claim empty box. If this happened in real life the buyer would be eager to cooperate with authorities to find out who stole from them so they can be punished and it doesn't happen again. Scammer will say "I don't have time for this....". |

Police don't care at all about this sort of things. Legally if you tell them ebay/paypal is asking, then legally they have to write you a police report. What ebay does is send that report to ic3.gov. Even ic3.gov doesn't care (it's possible the buyer is lying or post office lost it). It's like a tally system. Once they see MULTIPLE complaints about one person, then they might act.
Sold $400 item, buyer claimed "empty box".
Ebay asked for police report, then ebay refunded buyer.
Few days later I see a seller leave my buyer a feedback saying "be careful with this guy he will claim you sent him nothing in box".
Call eBay to rant (didn't expect anything). 'how can you let him get away with it', 'he's done this before, look at his 8th most recent feedback', etc.
Ebay rep cuts me off "sorry, don't mean to interrupt, but you are right, we only allow one of these per account. I've appealed the case. You'll get a payout in 24-48 hours".
Got payment from ebay $400 to my paypal two hours later.
Ebay knew this guy did this before. But once they found out I knew he did it before, ebay paid up. Ebay is the biggest scammer. I've never seen a company lie to customers face just to protect itself |
