| JamieStars | 11-09-2021 06:15 AM | eBay Scammer Hi everybody, got my first ever buyer claiming an empty envelope. It's a £150 order to USA with full tracking and signature. Have the receipt with weight on. He's left 7 negatives in the last 6 months.
Just wanted to double check the best way to handle it with eBay is?
He's opened a case, left me a negative and sent an aggressive message. |

He's opened a case, left me a negative and sent an aggressive message. | Definitely speak to trust & safety at ebay first. Go through the case etc. Any patterns of him doing things like this in the past then he will be banned immediately and case closed in your favor.
If it's the first time he's doing it then unfortunately unless you can prove with a shadow of a doubt that he didn't receive an empty envelope he wins the case. |

How aggressive? | Wasn't aggressive enough for eBay to care unfortunately. He did say empty envelope and not tampered with so maybe the weight of it will help me but it is just trading cards.
I've contacted one of the sellers he's negged to try and get a little more info before I call and present my whole case.
Did find him on Facebook, I thought Nurse's were meant to be honest. |

Explaining to eBay his pattern of leaving negatives could help your case. I've never used that as evidence in a case but I have used it to get negatives removed before (clear cut case of feedback extortion). |

The problem with this is the system will automatically favor the buyer. Funds will be held and "damaged" item will be asked to be returned, or seller will be asked to send item that was "not received".
Then there's the 3-Day Rule. Depending on who you talk to - and I suggest ending the call and requesting another call back if the agent seems like isn't siding with you - they will step in and close the case in your favor given the history of the buyer.
Regardless, that POS will appeal the case, he will win and Ebay will refund his money out of their buyer guarantee but it will be at their cost. Your money will already safe at this point. |

So he had actually only opened one not received case. He bought 5 cards, he just opened 4 returns for the other cards.
I think my best bet is to gather all the info and then keep trying eBay reps until I get a helpful one. |

I would even write something like, "I will be providing all tracking, and shipment information to ebay, I will also be contacting your Postal Service and providing them with any relevant information about the package. Finally, I will be contacting the FTC and filing a fraud case" |
| likefrasers | 11-10-2021 07:38 AM | Re: eBay Scammer you need to contact ebay and explain. I had similar case but opposite - receive a damaged item covered with dirt and grease. I took the pictures to ebay. Buyer left other sellers mostly negative feedback. ebay then refunded me full payment.
You might have some unfriendly agent to deal this at the beginning, but please keep on calling them until meet a helpful agent to handle this in your favor. I called them more than 20 times on that case. But worth it as it's expensive. |

Also both said there's a note on the cases that I should win. I'm not fully convinced it will be that easy.
After I presented all my evidence the buyer just said he will be escalating, he obviously knows the system. |

Ebay bot will rule in your favor.

Then he will have to go to his cc issuer and file a chargeback.
I have a case recently on Etsy,a buyer bought two pieces of silver from me ,and filed items not received,but tracking showed delivered.
I called USPS customer service 1-800 as I cant get hold of her local post office.
It forwards my complaint to her local post office and in 10 ten minutes,her mail man called me and said he delivered my package and told me mine has the pink signature confirm slip and other packages do not.
Etsy ruled in my favor as tracking shows delivered,it helps when I told them her mailman called and confirmed delivery.
Buyer cannot file chargback with her credit card issuer as she used KLarna(buy now pay later) instead.
