That sounds promising so do you think I will have a chance in this? My design is different compared to KL TeK limited ie digital display, reflection shown etc.

Here's a prediction, lets see how it plays out once OP starts listing their wares.

They will be vero'd by the other clown into suspension and their 'design' IP is worthless as a defence.

Just for clarification OP, is the 'design' of your own making or have you stolen someone elses image. I'm going to have a fiver on the latter.

You think because a low level support worker at ebay has paid you some kind of lip service about this whole mess then they'll side with you if a vero complaint comes in....absolutely no chance when they see you're already on the radar. Vero is great for attacking, not so as a means of defence.

The KL clown is on thin ice with the IPO if their behaviour and rights manipulation was brought to their attention but I believe it's quite and expensive process to make a formal complaint....or it was when I has the same tactics unloaded on me many years ago.

I appreciate that you intend to plough ahead anyway and I guess are willing to lose your account in an attempt to unload your stock, but forewarned is forearmed as they say.

Are you willing to share with us how much you're into this for?

I know how I'd deal with this but I don't think you've the fortitude to follow it through.

I hope it works out for you.

I deleted my posts but how a situation like this needs to be handled is not for this group. To combat a competitor like this takes some serious retaliation. If he is talking about anything less than 30K, it just isn't worth it. Especially if he is just branding a generic item.

I don’t know if that is correct Hank as yes ebay employees say things and sometimes say the wrong things but if I have a certificate of a design registered on the government website it’s classed as a legal document so if this company report me well this time I have my own legal document for my own design shown in the document and in my images.

I’m not trying to eliminate this seller it’s not my objection. My objection is simple and that is to sell my stock I have which is not branded by a company it’s just registered for a design so I’ve tried to do the same so I can hopefully list my items and just sell my stock.

If it works it’s a bonus and if doesn’t work then I’ve only lost the small fee paid for the Legal document.

I hope I don’t get any further reports if it’s been resolved but if ebay reinstate my listing and a report comes through I hope they will see my design is not the same and see my legal document attached I will speak in more depth with them if the document is accepted.

I’m trying to think positive and have faith. If the legal document/certificate is accepted I’m hoping ebay will allow me to carry on listing. If I get reported as another op said on this post I can report them for malicious interference in trade. Ebay take this very seriously and could result in their account being suspended.

Don't kid yourself, eBay will not get involved in 'interference with business' matters as they simply are not in a position to make legally sensitive calls. I've been there, I know how they operate, and how they put zero effort into overturning vero takedowns.

Look, you don't own any intellectual property you're doing nothing more than the LK clown is...it's worthless in any capacity other than taking down other sellers.

I am only playing devils advocate, everything we've discussed is pure speculation and guesswork, and so you go into the next stage with your eyes open and if your account is suspended you'll be magnanimous about it and accept it was all worth it over a few of grands worth of stock.

Once again I offer my good luck to you, it wouldn't hurt to plan ahead and decide what you will do for another account if the LK clown continues their attack and is successful.

Yes you are right I don’t own any intellectual property design but once my design is registered in my name I will then own the design and can register it on ebay vero program. I’m not doing this to wipe competition out the water I’m nothing like KL TEK it’s not my intensions I’m a good person. I’m doing this so I can sell my stock which I have every right to be able to sell it’s generic brand it’s not Apple AirPods it’s tws headphones and all sellers who have had their listings removed due to KL TEK paying the government £50 for a legal document is not fair and if I believe in something I will fight to the very end I never give up especially when I know the product I’m selling is a generic product.

For now I’m listening to ebay I’m not resisting until I get proof of document for my image if accepted I will speak to ebay about it and see where we can go from their.

KL TEK attack will not be successful this time trust me.

Get your certificate

Send a copy - through Ebay messages - to KL TEK stating you believe this does not infringe their IP rights

Contact VeRO with a copy of your message and any replies

TBH if the product is not manufactured by you it will be difficult to claim design rights. If you did not design it why should you have design rights?

Think about it - if you lose your account over this will you be sitting there in 6 months time wishing you had sold the stock for next to nothing

Your money, your account so its your call but in my humble opinion as you did not design these you have a mountain to climb to prove provenance

The product wasn’t manufactured by KL TEK Limited either it was manufactured in China and their is no way KL TEK designed TWS Bluetooth headphones. This is why I believe they have just registered the design in the U.K. if my design is rejected then maybe KL TEK did design/invent TWS but after doing countless of research I have no evidence that KL TEK designed, manufactured, or invented TWS

So sue them I guess.

eBay really never gets involved in cases. They will, vero and vero and vero until you give up or your account is closed.

Hopefully we are wrong but trying to brand a generic item rarely goes well when dealing with such aggressive competitors with everything to loose.
