MC011 - Funds held
 

HI, UK seller just hit with a MC011 and funds held.

I have stealth accounts running too, but this one is in my real details.

Are the funds gone?

Is it worth sending the items out costing me in post, or shall I just refund?

Really dont want to shell out £300 in postage costs if there is no chance of the funds being released.

Is your item a knock-off or possibly fraudulent item - if not then likely 60 days wait

I've had a couple of warnings saying they're counterfeit...

the counterfeit infractions are a concern but they still say "temporary suspension"

which means you still have some kind of a chance. I'd give them what they want for now and hope for the best while preparing for the worst.

If you ship,you are hoping the buyer does not complain it is a knockoff.

Usually 100days as I calculated. But if there are open claims it will delay that

If OP is selling counterfeit,and there is a good chance buyer would complain,then he may as well cancel these orders now.

you can cancel orders or ship them , if the details are real the risk is limited , the worst case scenario is indefinite restriction with payout delay of a few months

No,if counterfeit or knockoff,his fund will be confiscated.
No different than the Paypal AUP policy
sales venues like AMZN,ETSY,EBAY could be liable for allowing countefeits to be sold.alsp Paypal

In my opinion you should send out the products with tracking details, in the worst case scenario ebay will suspend you permanently but will payout after 60 - 72 days.

Be mindful though as once your account is suspended then some buyers will put in some cases and regardless of the situation ebay will refund the buyer without items being returned to you.

This happened to me, few buyers said they didn't receive the items but tracking proved it was delivered, ebay still refunded the buyer. I called in to ebay put an appeal in but ebay replied back saying as account is restricted buyer will always get refunded.

If it was me in this situation, I would send out the items and do what ebay want just incase they might accept the info.
