Vero and criminal complaint
 

I got a message on ebay to take down a listing regarding an item from a user saying that they own the item and will report me criminally for copyright appropriation


I placed this item from Amazon like my other 5k listed items, I dropshipping amazon to ebay

Can they do that?

ask them to introduce themselves and verify if they are who they pretend to be

if yes remove the item , if no ignore

1. No really... that's old textbook scare tactics. If they were the real owners, they'd not bother to message you, they'd just do it and poof... gone is your account.

2. You know amazon will soon or later nuke your account for this?

You have 2 hours to close the listing after which with all the master data already in our possession we will file a Complaint to the Postal Police to whom we have already reported your Ebay listing and your billing information. (master data)

I removed the list. Let's see what she will say. But yeah, idont want to blowup my money in lawyers and so on

I can't believe you fell for that, I didn't know there was a "postal police".

If they actually had Vero rights all they had to do was report to ebay and it would have got removed, your account doesn't get suspended because of 1 Vero violation. I went through this experience, my listing was removed and in the message from eb I was told to contact the vero rights holder and they included their details in the message.

I didn't have a pre warning from the Vero holders themselves, why would they waste their time sending out messages.

She said that she reporteted to ebay but she will not do any criminal complaint (her last message)

The fact that made me suspicious was that she said she had already contacted Ebay but later says to remove the listing or I will be criminally charged
But if you have already contacted ebay to remove it and you are 100% SURE you have copyright what is the point of me removing the list? Ebay will remove it soon so..
And then i dont undestand how she has the right of the images and other stuff pf a Company that has altready his store on Amazon and other marketplaces but she contacted me with her ****ty 30 sales new shop

Postal police is like an IT department of government that manages complaits in Italy

You said you copied the item from AMZN,is it from a third party AMZN seller?

Ignore those poster who tell you to ignore any vero threat.

I have trademarks registered with VERO, which I've used to take down sellers in the past.

But with Amazon dropshippers it's even easier. All you need to do is link the Amazon ASIN and they'll take down the ebay listing based upon copying the images and text as long as the ASIN was created before the ebay account. 100% success rate.

But I always fire off a message to sellers first giving them the opportunity to voluntarily take down their ebay listing. Many do and we both move on. Those that don't I set out to destroy their ebay account and they lose all listings not just the ones I asked them too. That way I don't feel as guilty.

Like I said, ignore any threat at your peril.

Yes but i'm using a method that i think is safe right now

There are dropshippers on Amazon that buy to the factory in china a big stock send to amazon and Amazon will handle the shipping and everything. Those people dont own the copyright and its unlikely they will call me to remove their products
I already talk with one of them
They do most of my sales btw

That's great, but some, like me also sell on ebay and, for my own reasons, I don't want you dropshipping my goods.

Dropshipping is a precarious business model, indeed it's not 'proper' dropshipping it's retail arbitrage.

It's frowned upon by both ebay and Amazon, the last thing you want to do is attract unwanted attention. It's an easy way for you to make money, don't get greedy. :thumb:

For what it's worth I wouldn't trust anything the Chinese sellers say, they are the most defensive of their accounts and products. They want all the profit for themselves and can be ruthless.

Very bad advice. That kind of pointless bravado will cost them their account.

They're already on thin ice with their business model, why on earth would you want to try and mess with vero issues?

I'm a nobody in the world of copyright but have closed sellers down, the Chinese are on a different level when it comes to resources and ruthlessness.

The account is just the last thing
Just with a basic knowledge you can create hundreads and in few months have an army of accounts

The real problem is that if she own the copyright of the images he/she can open a complaint and most of the cases win, so you lose a lot of money

Hoping that she didnt vero my items (that i've already deleted when i saw the mail) i should still have my account alive

The real way to overcome vero is to find European dropshippers (in my case) that buy stocks on Chinese werehouse ship to Amazon and AMazon will handle shipping and so on
They most of the time dont have a brand (or they have and its like "ifiefje" :lol: ) and just want to make some profit on that items.

Its rare that someone will complaint for an Item but when it happen is dangerous. So choose carefully the items and find those without copyright.

All big company names could have a lawyer that just send hundreads of complaint a day so dont expect just a little company to attack you (its not a hypothesis, its the reality)


Btw i woke up with +100$ profit on that store, its a shame to have it destroyed but who cares, i've gologin with 10 other accounts :)

copyright holder can send complaint to Ebay,others can report your listing to Ebay,on every listing,there is an option-report this listing,report this seller

anyone can complain but complaints by third parties who are not in VERO are mostly ignored , with VERO they are always accepted

It would take quite a few reports though for a listing to get taken down if just done through the report listing unless its a branded item.

If its a branded item depending on the brand and value it may get looked at manually

if theY buy from CHina and ship the goods to AMZN for fullfillment,they are not dropshippers,they have the goods ,they are FBA -fullfillment by AMZN.

Simplest move is to report item but if you are selling the same, you might have problems ....retaliation
