Received customs letter

my item was seized awhile back by customs...they did send me a letter letting me know...on the advice of forum members i disregarded the letter.
2 weeks ago i received a different letter titled "NOTICE OF FORFEITURE"

it stated if i wanted to stop the summary forfeiture proceedings and send the case to court, i must file a claim and post a bond. the bond amount is $10,000 or 10 percent of the forfeiture value of the property, whichever is lower.

i must file this bond and claiim within 20 days....

from the experience of other members, what should i do?
A. ignore the letter
B. seal the letter up in original envelope and write "return to sender" ?
C. file the claim?

i really do not want to make a big deal out of this, and customs can destroy the stuff for all i care (actually prefer).

the information has my real address but different name.
please advise.

ignore it, it means they will destroy your goods if you dont reply

nobody999 12-10-2009 02:21 PM

have you received such letter before?

normally you dont get 2 letters you get one and its all in their including forfeiture procedures and appeals etc, you got tow letters, but in essence still the same - dont admit anything, and as Eddy Murphy said - wasnt me

i've always received 2 letters. the first letting me know that my item was taken and informing me i can appeal and pay for it and all that. the 2nd lets me know that they will destory it. like a last call if you wanna pay for them kind of thing. just ignore both.

Normally you send the letter back to your supplier for a refund, how many boxes did you order anyway? that must have been a big shipment.

Unless that second letter is legally binding, and notarized by an attorney, etc. you do not have to respond at all.

Legally binding means that not only does the letter state what you need to do in correspondence with the law (e.g. your reply to the seizure of goods), but it also needs to state in legal terms the legal consequences if you do not respond (e.g. references to certain sections of laws of your state, etc. such as "if the party does not respond, they are hereby punishable under the full extent of the law to "such and such" in accordance with "section ## of ## of the "Act/Law/Jurisdiction passed in said year.")

So what I mean is you're technically not obligated to respond unless the law itself threatens you to do so, and I'm assuming that it is just customs itself requesting your admittance/ownership of the said goods (as remember that you can claim in a court that someone used your name and address without your knowing, etc.) Unless it is like an actual representative of a copyrights protection company, or legal section of a company, then yeah don't respond.

^_^

Or if you were receiving it to a mail drop in an anonymous name. You could ignore it no matter whats on the notice ;)

Just ignore it and try to get your merchandise replaced by your supplier.
