Can someone explain to me how they are getting away with it
 

There is a buyer on eBay, buying my products, and having them shipped to their customers (via myself), they are not selling anything on eBay, they have an amazon account with mine and many other products that I assume are from other eBay sellers. Anyway, my product that is on eBay is on this persons Amazon account, same photos, same description. They sell the product on Amazon at a marked up price, then they buy my product on eBay, and I ship it out to their customer. Now I'm not really complaining, as I'm the one that set the price on eBay, that's on me, none of my artwork is trademarked or Copywrited and its kind of free advertising for me. My main question is, the product is the type of product that is gated on amazon, so how are they listing such items on amazon?? This seller has never come to me asking for documents or anything. I'm asking this as I'm now seriously considering selling on Amazon

YOu can try listing one and see what happens

it is very well possible that your product is a part of another group of products for gating purposes so that they get one part approved and the other parts allow to list automatically

I will be creating an account soon, and go from there, see what they would require

Your products as in you created the items?

Perhaps create a brand register with amazon and see what the process is for your items to be ungated?

I have no idea how the process works, I guess creating a seller account is the first step. For years I have put all my eggs in the eBay basket
